Paypal issue but NOT via Ebay

Just wanted to remind everyone about this PayPal limitation.

I purchased an expensive item for my son's birthday via the internet. I chose to use the PayPal option to pay for the item as I thought that gave me maximum protection - how wrong I was.

I went onto the site and added the item to my basket. I then went to check-out and chose to pay via PayPal rather than a Visa card as I didn't want to give visa numbers etc. over the internet. Well, the item never arrived and the company in question never returned my emails.

I raised a dispute and waited the required time. PayPal have now decided in my favour as the seller didn't respond to them either. However, I now find that I can't get a refund as the seller wipes their account regularly so there is nothing to recover.

Having now done some investigation myself, I find that others have been scammed by this company in the same way and yet PayPal are STILL doing business with them:mad:

So lesson learnt - don't use PayPal, use VISA instead!!!!!

Buyer protection will cover you as long as you paid for stated goods and opened the correct claim. I concur with fay, exactly what did paypal tell you ?

Reading the small print of the PayPal contract, "buyer protection" does NOT guarantee to get all funds back unless you buy through ebay!

    The response;

We have concluded our investigation into your case and have decided in your favor.
We were able to recover 3,39 GBP and this amount has been credited to you. Please allow five business days for this adjustment to be posted.
If you are due any additional funds, we will make our best effort to recover the balance from the seller.

If the seller's account has insufficient funds to complete the refund owed to you, please be assured that we will take appropriate action against the seller's account, which may include limitation of the seller's account privileges.

I have also had confirmation from PayPal that they will not be looking to gain more funds other than through the email they've sent the seller - fat good that will be then!

    There's missing information.
Did they deal with it under buyer protection, or buyer complaints?

If I am reading the post correctly, this is NOT anything to do with an ebay transaction. The OP used paypal to pay for an item purchased via the internet

If this is the case any dispute will be dealt with under the buyer complaint policy, as posted above, and paypal will only be able to recover what is in the seller account, so a full refund is NOT guaranteed.

Did you fund the paypal payment with a credit/Visa debit card?, if so it may be worth contacting the issuer to see if they can help

You are correct it has to be a buyer complaint and NOT buyer protection because ebay is not involved as per the title of the thread.

Yes I did with a Visa card but "section 75 protection" does not apply when paying for something via a third party (PayPal in this case).

    So, please all be warned!

AFAIK if any money were to hit the sellers account in the future paypal would then refund the buyer
