Because the money has been borrowed from a bank - where is the money? Spent it? Oh yes we forgot that little detail, if it was the lenders fault then the data should be amended asap to make sure the OP has his/her credit files updated accordingly - and repay the bank what they legally owe them, if however this is a case of...oops, I used a different name other than my own, then the OP will be looking at a criminal record for fraud. I am not implying that the OP did this however I am just showing the other side of the coin so to speak.;)
No, the fact the money was spent wasn't forgotten, however, if you read the OP's post he/she has stated that the bank has told them not to pay until it is resolved. I tend to take the post at face value, so what the money was spent on is of no importance.0 -
It would seem to me that the full facts are not entirely clear here and I always feel that it's best to know the full facts before leaping to conclusions and where the money went is potentially one small link in the unclear chain.

But anyway the answer to the question based on the information available is No the loan wasn't mis-sold but who knows it may be unenforceable.

Spent all the money (who knows or cares what on, candybars probably) :j
Hasn't made a single repayment
Has indicated he will struggle to make ANY repayments so can he have the loan written off and simply ignore it. :mad:

As I said, I take people's comments at face value, so if the OP says that the bank have told them not to make a payment until the situation is resolved, then I have no reason not to believe them.0 -

At least someone on hear is still prepared to listen to people. Just as an update, I have tonight spoken to my brother and both myself and him have complaints pending an inquiry (Although brother already has a letter advising issue resolved and received £100 compensation from said bank)..... this clearly wasn't the case as I tried to call and again they have no knowledge of me and WILL NOT discuss the account. As their 6 weeks for their complaint to be resolved is up for both of us on Wednesday, with no response we will both be writing to the FOS to have the matter resolved once and for all.
Thanks for any advice I/we did received though - it is appreciated.
One things is good though, at least I AM earning a little interest whilst this money is in my bank lol0 -

OMG - I never said I didn't have the back payments, just I cannot make them as said bank will not discuss the account with me as It's not my name on the loan. Brother will not pay, and rightly so as he didn't borrow the money.....
I cannot believe how many people jump to conclusions on here, it's crazy!0
