Hardship Claim Nationwide Refuse

Nationwide sent me a statement of means form after I wrote to them about facing considerable hardship. I am off sick have been since july, have a 5000 loan which i pay only 5 pound a month on and a credit card which i pay 5 a month on (1000 outstanding), another credit card of 1000, a bank overdraft of 1500 and my bank overdraft with them (250) I only get 60 pound a week and they said Sorry No!???? I am in constant overdraft and just informed them of another debt/fee driving offence from 6 months ago, 170.

They said that this is because my financial hardship did not occur because of the charges, that the charges were made a long time ago (still within 6 years) and have nothing to do with my current hardship.

Do i really have no comeback from this? They owe me next to nothing compared to most people, but seriously im drowning here. I really cant believe it.

Any advice, please???? So they will only repay if i can prove these charges are linked to my CURRENT hardship?? seems a bit rediclious considering most people's charges are in the past.

thanks for listening and grateful for any help

Katy, I am sure I have seen your post before. Have you got any priority debt arrears(mortgage/rent, council tax, utlilities)?

I did post quite a while back, not within last year though.

The only priority debt is my court fees and fines which must be paid everyweek.

Most of the banks are looking at severe financial hardship as priority debt arrears so it merely from the above, I would probably agree with nationwide on this one.
Have you posted on Legal Beagles forum or consumer action group?
I may be having a groundhog day, not hearing sony and cher yet though ;)

EDIT: any credit card charges you could claim?
