Received a reply to my MBNA SAR request which was signed for 37 days previously yesterday & I was wondering if anyone else has had a similar reply from MBNA and also what should I do next ?
I refer to your recent correspondence regarding your request to provide you with personal data and other info held by MBNA.
To comply with this request, I enclose the following data:
A copy of the executed agreement together with current terms & conditions
Account transaction history
A copy of the signed credit card application form & agreement is not available due to archive retrieval issues.. Should we hold any correspondence for the account, in accordance with section 7 of the Data Protection Act, this will be forwarded within the 40 day time period.
The copy of the executed agreement is a new one as it only shows charges as £12 and there is no signature box on the agreement !!!

Both really got a list of charges which were originally £25 but then changed to £12, but have no CCA and not sure how to go about getting one with them quoting

HAvnt seen that "bull****" statement before - retrieval issues.
How about, more accurately, "we havnt got it any longer" or "we never actually got you to sign one"
They are trying to pull a fast one. MBNA have very few CCAs (unless account was opened recently).
Dont think I have seen a vlaid one in the whole time I have been wroking there. No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

I can never remember signing one so dont think they have one. Was thinking of sending some kind of letter about lack of CCA and them being in default but not sure what to do now.0
