Hi,

I have a claim in the system as it were, which like many others are waiting for the court results.
However, where do i stand with charges i am still getting, if i complain they tell me i have already complained and cant do anything, and these charges are being added to the orginal claim!!....surely this isnt right?

You can go back to the bank at any time, and ask them to relook at your existing claim plus any other charges. Do you have any priority debts(mortgage/rent, utilities, council tax)?

    Yes, NWSM meant:

Do you have any priority debt arrears(mortgage/rent, utilities, council tax)?

ie are you in financial hardship.

Nothing stops you from complaining about new charges since your last claim but it is unlikely the bank will pay out until the conclusion of the OFT test case.

After reading through the website, i have had more than £500 charges over a year so should be able to claim for hardship!

    "vii.
repeatedly exceeding a credit card or overdraft limit without agreement (and, in this regard, where a complainant has incurred over £500 in unauthorised overdraft charges in the previous 12 months, that is to be treated as indicative of financial difficulty)."

Having read the waiver, being indicative of financial difficulty does not mean that you are in financial hardship. Having seen many threads and having an idea as to the way banks are paying out, you might be wasting your time. However, if it is Barclays, they do seem to be the in vogue payers outers. If its not then I would get the claim in for the additional charges but don't expect them to pay out based on hardship. From what you have written you will be disappointed.
