Hi all, i need some advice ref ; Natwest have failed to produce a valid agreement, i have sent off a 12+2 letter.
today i recieved notice of termination and they have said they will accept £1 per month for 6 months and no interest will be added. they go on to say that if i do not accept these terms and default on this arrangement they will recover all monies owed.
what should i do?.... ingore await for them to produce a valid cca or pay for 6 months to keep them off my back.

Is that offer in reply to your 12+2 letter? Or a spearate thing?
If they can't produce a valid CCA the debt is unenforcable, so if it were me I would be asking them where is the CAA, I think there is a letter you can send after the 12+2 letter asking them to let you know their intentions but it's not the old 12+2+30 one. it ight be somewhere in the template letters thread HERELBM 26th April 2009 Debts at LBM £7777.49:eek:
CC [STRIKE]£451.98[/STRIKE] [STRIKE] £383.30[/STRIKE] £190.00
Natwest OD £1679.52
Natwest Loan [STRIKE]£6072.99[/STRIKE] [STRIKE]£5888.96[/STRIKE] £0.000 -
Thanks RJ,
I think this appears to be seperate from the 12+2 letter as it is from their debt recovery dept. i did incidently send off a letter a couple of days ago after advice from this forum, it was the "you must realise that this was not a cca, you have a further 21 days to comply" letter.0 -
If they've terminated your agreement, did you receive a default notice 1st?UNCLE_BUCK wrote: »today i recieved notice of termination
If they commence litigation against you, they will HAVE to produce the CCA agreement which they claim you've breached.Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
Natwest failed to produce a CCA for me - they sent me a letter saying it was misfiled and that they realised that they could not persue me for the money, but said morally I should pay it - I've chosen not to - and have now recieved a letter asking for my repayment proposals - they are trying it on as they are with you - there is a letter template here somewhere in the vein of why are you hassling me when you haven't provided the correct documentation.0

yes 10 past, they did issue default which i took advice from this forum and i do not think even the default is valid/legal.
natters tend to agree that they are just trying it on, i think to start paying even a pound a month would be an admissission of the debt.
thank you both for replying0 -

Thanks for the documents, OK, the default notice is defective :rotfl:it does not comply with legislation.
The termination of your account is unlawful, they cannot terminate your account until they issue a correct default notice, as they've issued a defective default notice it makes termination unlawful.
Oh, and no, they cannot issue another default notice because they've terminated your account :rotfl:
As a side note, I notice in the blue letter dated 29th April they state "your proposals for repayment are unrealistic" yet they're willing to accept £1.00 pm
what did you offer, 0.05p per month? :rotfl: Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

That is great news about the default/termination letter.:D
Thanks again 10past6, your a star:j.
Do i just sit back and wait or do i make the next step???.
I am totally bemused by the "offer unrealistic" i have never made them an offer.
.
do i presume your advise would be not to pay the £1 until they comply with my original request?.0
