    Any T&Cs of an agreement state clearly what action the creditor can take once those T&Cs have been breached.

    Should Nasty West so desire to commence litigation against you, they MUST comply with consumer law in order to bring a claim, in your case, they've breached consumer law by not issuing a legal default notice.

    The difficulty most consumer's have is, translating the correct legislation over to a judge, never, ever assume because it's a judge there up to date with consumer law, most are not!! ;)

    I'd say that's a sit back and wait.

    You've sent the 12+2 day letter stating that the debt is unenforcable, therefore payment need not be made until the agreement can be enforced. I'd jsut ignore their £1 ofer and complain to TS should they pursue for payment without complying with their legal obligation to produce a properly enforced CCA.
