Date getting nearer panic setting in!

Hi

As the date approaches my anxiety levels are rising rapidly!

Have gained a lot of helpful information and guidance from others on this board so have a few more questions

Brief recap: My husband is being made bankrupt by a firm of solicitors -
do they have to attend court for the bankruptcy to go ahead?
what happens if they have to attend and do not?
does he need to bring anything with him, and if so what?
Does anyone have a time machine so I can travel to around 3.00pm on Weds please! to escape all of this!:D

    If you are a petitioner's BR I don't think you have to attend court unless you are opposing the action. This was the advice I was given by CAB.
    I was 'made' BR and didn't have to take any action at all until the trustee dealing with my case got in touch with me.
    Try to relax, I know it's difficult, but worry gets you nowhere.
    It's really not as bad as anyone fears :)

  • It might be worth giving someone like National Debtline a ring to go through what you can expect from the bankruptcy, so understand all the implications of what is happening.

    It also might be worth going to the court so you are aware of what is happening and will know if the firm decide not to go ahead with it as happened to one poster.

    We are thinking of going to the court as you say just to see if they do turn up (I had read the other poster when this happened to them). Well time will tellas they say!

    If it was me, I think I would show up just because I would hate to be sitting at home waiting and wondering. Just a couple of things to consider. Make sure your bank accounts are cleared out of any money on that date just in case the OR wants it. It is unlikely but I have heard it happen before so in case you have your money for rent/mortgage/living expenses in the bank then make sure you take it out at least until the OR releases your bank account. If it is just your OH going BR then anything in your personal account will be fine and if you have any joint accounts I would try and get his name taken off or else open new accounts.

    I feel the same I want to be there but then again I don't if that makes sense.

    We do have a joint bank account is it possible to have my name removed? the account was originally my father-in -laws and many years ago my husband and was added to the account, shortly after my father -in-laws death I was added. I have been named on the cheque book but have never had a cheque guarantee card in my name (do not know if this would make any difference)

    Hi flo

    My thoughts are that it is somewhat rare for a creditor to make someone bankrupt....except for HMRC of course ...its costs the creditor & then unlikely to get anything back !

    I would definately go to the court but beware in case the solicitor is using this as a ploy & pulls out last minute. I think this happened to Mercman ( apologies if I`m wrong MM) ....got all prepared only to find out it was a creditors ploy!!!!

    Try & relax, keep an open mind & take everything a day at a time.
