Company take over - fair redundancy selection process

I work for a small company which employs 3 administrators to do the same role. My boss passed away late last year and as a result we were informed that the company would be sold. Since his death, the new 'potential buyers' of the business have taken over the role of my deceased employer. I should mention that they have their own business and staff doing the same thing we do and that we all work under the umbrella of a larger organisation who have been dealing with the sale and that the sale hasn't yet gone through, but is nearing the final stages.

We had a meeting at the end of last month with the new buyers who informed us that they would require two of the three of us to work for them at new premises, however, on Monday this week we were called in individually by the new employers and told who they were keeping and that it had become necessary for them to reduce the number of staff they would keep due to the current economic climate. I have been selected for redundancy, but haven't been given a reason why my colleague was chosen over me.

The following day I was given my redundancy notice by my current employer. My current employer has given me the correct notice period of 4 weeks and have given me the option to go two weeks early, which I am taking to register with agencies etc.

Have I been chosen for redundancy fairly? Please help.

You need to ask them for the scoresheet used to mark you against the criteria they used to select you for redundancy.

And you should take a look at the ACAS Guide to Handling Redundancies as your employer should have followed the guidance in that booklet.

Just to be sure, have you worked there 4 years (you say your notice period was 4 weeks) but if you have worked there longer than this you are entitled to a weeks notice for every year you have worked there and a weeks redundancy pay (age dependant) for each year you have worked there. both up to a maximum
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • Many thanks for your advice, much appreciated. I have only worked for my employer for 18 months and so I am not entitled to any redundancy pay.

I believe they have just chosen the person that they want for the job, who to be honest does have the most experience in this job (12years) and who lives very close to the new premises, where as I would have quite a distance to travel and have only been doing the job for 18 months, so no comparison really!
