If you paid this by direct debit then speak to your bank and they should be able to get the money back from you, if you paid by debit card then the bank probably won't be able to get it back. You'll need to contact the company and ask them to refund it.

This happened to us in January with Bulldog Broadband. They took money from our account by debit card after we had told them not to. The bank said that as we had given them our card details they have no control over what they take, however if it had been a direct debit that had been taken after we had cancelled then they could reclaim the money as the direct debit is a contract between you and the company.

I don't think you should have had to pay anything in January as you had already given them 30 days notice in December, did you keep a copy of the cancellation letter or get a receipt when you handed it in?

Some companys will go to any length to get more money out of you.
  • Unfortunately I didn't copy the letter, I was in such a hurry to write it and hand it into the club that I never thought to do that. I never got a receipt either.

Just phoned the club again and spoke to the same person. I told him that it wasn't really fair that I had ended up paying for use of the club up until the end of January without knowing and as a result didn't get to use it. He said it wasn't anyone's fault at the club and there's nothing they can do. I asked to speak to a manager and she's supposedly phoning me back tomorrow. If that doesn't sort it out I will contact my bank as it was a direct debit.

The bank told us that if you have told the company of your wish to cancel the direct debit and they took money after that then they are in breach of the direct debit contract. Unfortunately ours wasn't direct debit so I had to fight with the company to get it back. So if they don't budge i'd definately contact the bank.
  • Hi guys
Less said about fitness first the better - my boyfriend cancelled and sent a letter - as they didn't receive it they sent really nasty letters threatening court action and the lot. He coughed up twenty quid just to get shot of them. Does make me think though that they must have spent much more than that with all the letters etc they send????
Doesn't exactly inspire me to go there, I must say!
  • The bank were no help either, they said they needed the company's permission to refund the money.
  • Surely they must still have the letter you gave them. When you speak to the Manager tell him that you have a copy of the letter and that if he doesn't refund you you'll go to the local press with it blah blah...that should do the trick! ;)
