Business bank charges.

I started a claim for unfair charges, totalled up the costs, sent it off and waited. I then received a letter today from LLoyds, stating that as the account is a business account I cannot reclaim! does any one know if this is correct? I thought unfair charges were unfair charges?:mad:

I'd expect them to be citing the penalty charge aspects of the test case judgement, but if you can type up the relevant part of the letter it would be of interest.

Business claims can only claim under common law - not UTCCR - and the test case adjudged the personal account terms to not be capable of being penal under common law - this of course may read over to business claims, but then again it may not, it really depends on the terms.
