Trading Standards no use

I bought a MEDION desktop around 15 months ago from TESCO. On 12th NOVEMBER 08 it developed a fault in one of the USB ports on the rear. I contacted TESCO who put me through to MEDION. Medion took it for repair and 2 weeks later I recieved a bill for £249 to replace the motherboard. I told them it was under warranty and I had enclosed copies of the original receipts.

4 days past and I got a phone call from MEDION telling me that the bill for fixing my PC was now £315 as they could not source a motherboard and would have to put an upgraded one in.

Another phone call to tell them it was under warranty and this time I faxed the receipts. 4 days later I get a phone call telling me again that I would have to pay £315 for the upgraded motherboard as they didnt make my original one and they had no stock. Again I sent the receipts.

3 days later I phoned to see what was happening and was told that they had "found" an old type motherboard and would install it under warranty. This set the alarm bells ringing and I wrote to TESCO to tell them I wasnt happy.

I got the PC back 2 days later and it was worse than I sent it with no USB, E-sata, sd card slots or sound. The PC was picked up 4 days later. and returned after 11. This time it wouldnt boot at all. PC was picked up 5 days later and returned after 11 again. This time my Video card was malfunctioning showing artifacts and crashing. Pc was picked up 4 days later and returned to me 14 days later. This time it seemed to be OK.

TESCO meanwhile did not reply to my letter. They also would not discuss anything over the phone and said it was nothing to do with them and it was MEDIONS fault.

Skip now to february 09 (14 days before warranty runs out). PC again has USB, e-sata problems. I send it back and get it back on the 16th (the day the warranty expires). 3 weeks later and the PC developes another fault with Video card. this time MEDION say it is out of warranty. I tell them that according to TESCO "ALL repairs are guaranteed for 3 months" they said that was not thier policy and I would have to pay.

I contacted TESCO and they said they had no way of enforcing the 3 months policy and that I was out of luck. I contacted trading standards who have written 3 letters to Tesco and had no reply. i did get one rather cheeky phone call from Tesco customer services who asked me where it said about the 3 months repair and I told him it was on thier information sheet they put the receipts in. He then said that the old blue one was superceded by a white one and they were no longer valid so I had no claim.

I told him that as it was valid when the contract was made then that is the T&C that should be honoured. He asked me to fax it to them to prove it. I asked him for the fax number or an e-mail and I would send it and then he said "It doesnt matter" and hung up. Since then I have heard nothing and now trading standards has told me as TESCO will not respond then there is nothing they can do.

Does anybody know of anything else I can try??? Any addresses for more senior people or managers or something??? Has anybody had any dealings with TESCO at all??

    Escalate with Trading Standards. In my experience, it is the only way to get anyone decent with some fire in their bellies.

    Trading standards say there is NOTHING they can do if TESCO wont talk to them. I have had this from 3 different people now and all they keep telling me is to fix it and try through the small claims court

    Pretty pointless having Trading Standards. Wow, what a way for traders to escape them - just ignore them!

    Did you pay by credit card?

    Paid by credit card but as it is now a year they are unwilling to do anything

    Looks like its "The Judge" for me then... Just need to remember which newspaper its in now...

    The problen with trading standards is they depend on traders cooperating voluntarily. When I involved TS in a recent dispute, I was told that In the absence of cooperation, TS can only take action where a criminal offence has been committed, So pretty useless really.

    thats where im getting hit too. the credit card company says its over 1 year old.
    but now im trying under section 75. havent got anywhere yet but thats an option for you:rolleyes:

    There might be some advice on the HM Courts Service Money Claim Online website: http://www.moneyclaim.gov.uk/

    It gives advice as to how to make a small claim, what you can claim for, etc.

    I'd write one final letter to each, detailing the entire complaint (names, dates, receipts) and copy in any local or national press/ TV stations that have a complaints column. BBC have Watchdog and 'Don't Get Done' for a start. List everyone you have copied in at the bottom of the letter so Tesco know you are not taking this lying down. Address the envelopes to the customer service manager and/ or managing director. If this fails you should have a good case for the small claims court, however be aware that it always used to be that the other side could choose the location of the hearing so you may have some serious travelling to do.

    Thanks for the advice. I am going to do what Fire Fox suggested and write a few letters and see what happens from there..
