HELP with this problem i have please!!!!

Hi there im after the mse advice on what i can with regards to a problem im having .

following on from this thread.................

http://forums.moneysavingexpert.com/showthread.html?t=1548871&highlight=

i contacted trading standards who were going to contact the company that fitted the door.

this is the reply ive had from ts........

Dear Mr & Mrs Heatherington

I have had a response from Windoor Care UK. A Mr Edmunds has contacted me and stated the door was installed well over 12 months ago, he stated the installation is approaching nearly 2 years. Mr Edmunds stated he is aware you do have a 12 month warranty and he also stated Windoor Care have been out twice to adjust the door. Mr Edmunds stated on the second occasion they adjusted and resealed under the door. He also stated it has been 2 years and now the warranty has run out. Mr Edmunds stated he is happy to rectify but only if there is an extended warranty involved. During our conversation Mr Edmunds also mentioned someone may have tampered with the door.

Would you be able to tell me whether you do have an extended warranty with Windoor Care for this door?

Kind regards

this is the reply im sending to her as im getting quite wound up about it now.....

Dear Sana Arshad

thank you for the reply.

i am absolutely furious with the response you have had from windoorcare.

first of all the door was fitted in December 2007, so how he calculating 2 years is beyond my mathematical knowledge.
When i raised the case with consumer direct in Feb this year , that would make it 1 year and 2 months since fitting.

Mr Edmunds (whoever he is ) is correct that they have been out 2 times to rectify problems one of which was sealing under the door, however its is not this that is the problem.

The problem is that the frame has been incorrectly fitted which in turn is affecting the door.
Also its the sealant and trim around the outside of the door that is coming away.

I fear that (god forbid) my house was broken into and the insurance company checked for the security of my front door then thy would cancel my policy as it is not secure.

As for Mr Edmund saying that someone has tampered with the door then i find this quite slanderous as this is simply untrue.

Would it be possible for you to come and view my property so i can point out all the problems with the front door and you can see for yourself the shoddy work they have done.

As for the extended warranty i was never offered one with them, however we never received a fensa certidficate for the door either.(which apparently is a legal thing now)

what can i expect to happen now as i feelas though im fighting a losing battle.

I have no idea but what I do know is that you need to correct the grammar and capitalisation (the word I is always capitalised) before you send them anything

Not having a go but you're unlikely to be taken seriously if you send them the letter as it stands.
  • Sorry should point out that the letter is a draft at the moment!!

Firstly, do you have any evidence that the work was done in December 2007? Invoice/Receipt? If so, take a copy of that.

Next - whilst I fully understand that you are angry, it really adds nothing to your case to communicate angrily. It's far better to remain calm, cool and "professional".

A suggested letter for you to consider.

    Dear Sana Arshad

Thank you for the reply and your efforts to resolve this on my behalf.

The door was fitted in December 2007 (see enclosed ???? receipt? invoice?) and, as I originally raised this matter with Consumer Direct in Feb this year, the door had been fitted for 1 year and 2 months at that time.

I confirm that Windoorcare have been out twice to address problems with the door; one of which was sealing under the door. However, that is not the issue in dispute.

The problem is that the frame has been incorrectly fitted which in turn is affecting the door. Also the sealant and trim around the outside of the door is coming away.

To the best of my knowledge, no-one has "tampered with" the door. Certainly, I have made no attempt to deal with any of the problems encountered to date.

On the matter of an extended warranty, this was not an option offered to me at the time of purchase.

I appreciate your help with this matter and hope you are able to pursue it further with Windoorcare. However, do please contact me if you need any further information.

    Yours sincerely

Re the FENSA certificate - is Windoorcare registered? You can search the FENSA database of fitters here. If they're registered then simply ad "Incidentally, I have never received the FENSA certificate either, although my priority at the moment is to have the current problems resolved".
Would it be possible for you to come and view my property so i can point what can i expect to happen now as i feelas though im fighting a losing battle.

You need to be patient as this is how dispute resolution works. Trading Standards are not just going to jump all over Windoorcare - they will want to hear both sides of the story AND satisfy themselves that Windoorcare have a case to answer.

Allow Trading Standards to attempt to strike a deal with Windoorcare and don't expect TS to go in with "all guns blazing" in the way that you might like to.

  • hi all
this is the latest reply from trading standards......

    Dear Mr Hetherington

I have read through your email.

Unfortunately with civil complaints, such as these, I do not have the powers to force the trader to offer you a particular remedy. Windoorcare have stated the door may have been tampered with and from my conversation with Windoorcare they did not appear to be willing to offer further rectifications.

In order for me to progress the complaint and provide further assistance, if you feel the faults with the door are inherent, you could consider whether to obtain an independent report on the door. If the report is in your favour I will then be able to go back to Windoorcare since I would have a report, which shows the fault to be inherent. Obviously this is dependent on you and if you wish to obtain a report. We do have a trader register, I have given the link below. It may be worthwhile having a look on the register as someone on there could provide you with an independent report on the door.

I feel at this point without an independent report I cannot go back to the company. I hope the above is of some assistance.

does anyone have an idea on how much an independent report is likely to cost??
