RBS (Credit Management) PPI Claim - lost records!

Hi All,

To start with, I spent my early twenties getting into debt and my late twenties paying it off! I've paid off over 25k of debt in 5 years, and claimed 6k from HSBC for bank charges and PPI.

One of the loans I took out was with RBS, in 2001. I defaulted in 2005 and ended up with a CCJ (My own foolish fault). Since 2005 I've been battling with RBS's credit management services dept in Telford. The list goes like this:

- Took 9 months (of stress) for them to admit they had 'misplaced' 900 pounds worth of repayments. They offered 250 quid compensation, but convietly lost the letter I signed to accept this money. They are still refusing to pay this compensation.

- Despite recently sending out a letter stating that they were now legally obliged to send me monthly statements, I still haven't received any since 2005!

- NEED HELP ON THIS ONE! At the time of taking the loan I was not asked about PPI, so recently I called the CMS dept and asked if there was PPI on my loan. They confimed that I did! They added it to my loan without even discussing it with me!

I sent the template letter (from this website - thanks Martin!) to obtain the information pertaining to the PPI - now the funny part!

They clamed they didn't have the financial details of the policy, but were happy to send me an ilegible copy of the T&C's!

I've recently sent a letter explaining that I needed the finacial details of the PPI, and whilst they were at it, I explained the policy was mis-sold (well, not even sold!), and that I wanted a full refund, plus interest. I'm, waiting to hear back - unless of course they are up to their old tricks of 'misplacing' letters!

It's clear that they not have this information, and even though the policy was taken out more than six years ago, the loan account is still active (I'm still paying it off), and thus this PPI information should be available. Can anyone suggest what I should do if they are unable to fins the PPI info? I'm happy to pay off my loan (I took it out!), but I don't want to pay for PPI I never agreed to - many thanks in advance!

    Hi there

    As this is still active they should still hold records of your loan on database.

    If your having trouble with this, maybe the Information Commissioners Office (ICO) will be able to offer some advice or help in some way, I know it can be more difficult in retrieving information going back longer than 6 years, but like you said your still paying for this loan.

    Just give the ICO a call anyway and see what they may suggest:

    I've just chased them up and those incompetent fools at RBS, CMS, Telford have sent my letter to direct line insurance! Of course this policy has lapsed and direct line have no records relating to me - another RBS black hole!

    They've now offered to send it to their Manchester office which deals with PPI claims - does anybode have the address for this office? Think I'll send them a copy as well, just in case!
