George Wimpey faulty shower debarcle

Hello everyone,

I hope that soemone is able to help me with a consumer rights problem.

I bought a new George Wimpey house in Dec 07. Since then I have had nothing but problems with the upgraded shower that we had installed. It first went wrong in Jan 07, it was looked at by a Bristan engineer and they said that it was neccessary to have the shower replaced. This took almost 2 months, all the while me and my partner had to use the bath every morning instead of the shower, as you can understand very inconvenient! This new shower then went on to develop faults. We were informed that there was nothing wrong with the shower and it was the tiling and the sealant around the shower tray that was the problem. Unbeknownst to us, it was a slow leak which caused water damage to the tiling and to the bathroom ceiling below. These were repaired (very shoddily) by George Wimpey several times. After this had happened for about the 5th time, we insisted that the shower manufacturer sent out an engineer to look at the shower again in Feb 09. He turned up not even knowing what model the shower was, scratched his head, replaced a hose, and claimed it was fixed. Since then, we have had MORE problems, it is clearly not fixed.

I went back to George Wimpey and have requested that I want a refund for the upgraded shower that we paid £349 for, and the tiling fixed again, and the standard shower that all the other houses had installed, covered by the house purchase price. They have informed us that Bristan, the shower manufacturer have refused to offer a refund and said they have a right to repair, even after all of the previous problems.

Sorry if my post has been very long winded, but does anyone know if they do have this right? Considering that they have already been out once to fix it and that this is the 2nd faulty shower we have had from them?

Do we have the right to a refund?

Thanks in advance,

Sam.
