Nearly BR Time! Council Tax Question

Well only a few weeks to go thank god.....spoke to our previous neighbours, who have spotted people sitting outside our old house for ages and looking through the windows....so glad we moved out when we did....
Our mobile phone is going 10 to the dozen all day every day....
Anyway we are preparing our SOA's:
We are paying everything (including the rent) out of our WFTC's, we are not paying the council tax as we cant afford it, now what do we put for the council tax on our SOA????
Once we go BR we will be entitled to housing/council tax benefit but until then we are unsure as to what to put on the forms...Should we put the full rate down???

Hi - sorry don't know the answer - I imagine it might be a common problem so could be worth asking on the bankrupt board for this.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0

I think, although I am more than prepared to be wrong, that you cannot put council tax debt onto a bankruptcy petition. If this is the case, then paying the council tax (that and the fact you can be jailed for non payment) would surely make it the most important bill to pay?0

If the council already has a liability order then the CT is not wiped out by going BR.
I think you need some proper advice re benefits as well as I struggle to understand how you might become eligible for CTB and HB once you are BR and are not eligible for the same benefits now.If you've have not made a mistake, you've made nothing0 -

You are wrong I'm afraid. Council tax arrears go into the bankruptcy.
Assuming that the council has agreed to the current year being paid by instalments, any arrears (calculated on a daily basis) in this up to the date of the bankruptcy order can also be included. The council would then have to submit a new bill for the remaining of the year, which since it relates to the period after the BR would be payable.

Not true exactly. Since the liability order makes the whole bill payable immediately, it is included in the bankruptcy.

I wasnt asking for the debt to be included in the BR ,,,, just what to put on the soa as an outgoing.....

RAS in answer to your question ... we are not entilted to HB pre BR due to us (on paper) owning a property...
Once BR we will no longer own the property and will be entitled to help...
This is a long story (see other threads), we have sought expert help hense the BR ...0 -
