Looking for some advice. Taxi driver crashed into daughter's car - its a Perodua Myvia (Malaysian car), I know, but she won it so she kept it. Anyway that was on 12 February, garage are still saying no parts have arrived yet, they are coming from Malaysia!!! Insurance company won't give her a courtesy car, because she didn't tick the box, but they still wont do anything about hurrying up the parts. Garage have given her 3 different dates, and now they have told her it will now be 30 May before she gets the car back. The garage are now saying that the manufacturer is having trouble getting the parts for a brand new car!! What can we do? Please help.

    You could try ringing the Taxi drivers Insurers and asking them to provide a hire car, if they know they are at fault and you need one they are normally happy to offer one as they would rather pay for one themself at normal or discounted rates rather than you go to a credit hire company who will charge them a fortune.


    Give them a call, be polite and explain the circumstances, providing you have a need for one they should help you out.

  • Yeah you should be able to charge the cost of hiring a car to the other drivers insurance company.

    I personally think this should be included automatically in all comprehensive policies, regardless of who is at fault and what boxes you have ticked.

    I don't know how a insurance company could argue that they are offering indemnity (the whole point of insurance) if your car is off the road and they refuse provide a alternative car. Anyway thats just a little side rant.

    Although the taxi driver ran into my daughter (she was in a yellow box waiting to turn right), they haven't decided who was at fault. Daughter has an independent witness who said you could very clearly see her, and that the taxi driver was driving far too fast, so they wont give her anything until it is sorted out.

    Why not consult a solicitor regarding this problem. If the third party is liable, then they will have to compensate you for the costs involved in arranging alternative transport whilst the car is in dock. The insurers will take as long as they want to decide liability, and if you are the innocent party in all this you shouldn't be suffering as a result.

    If you are confident about winning and the decision going in your favour you could look into http://www.helphire.co.uk/.

    They provide hire cars and charge back to the other parties insurance company (at a nice fat profit i believe)

    If you go down the credit hire route be fully aware of what you are getting into as there are possibilities that you will be responsible for the cost of the credit hire and the charges are massive.

    There are possibilities, but you can insure against them.

    And generally only if you haven't told them the truth! You can take out an after the event insurance against ending up with the bill for £10.

    Although the charges are high, they operate on credit (ie don't get paid till the insurer coughs up), and give you like for like transport. (Courtesy cars are usually cheap and cheerful mini type cars, no good fdor you if your Previa is in dock thanks to someone else's poor driving).

    They give this safeguard publicly on their site:

    As long as you have told us the truth and continue to co-operate with us we will honour your case.
    The £10 insurance policy you were asked to buy through us at the outset would protect you from having to pay.

    I deal in car parts all day and regularly struggle for parts for thing like Perodua, Ssangyong, Proton etc The importers hold very little stock and so parts have to come in from Malaysia/Korea and 12 week wait for parts is not unknown. The insurer will have no way of hurrying up the parts as they come by boat.

    The highway code clearly states in rule 174 that you may enter a box junction to turn right, if you way is clear or only blocked by oncoming traffic. Without knowing the layout of the road it is far too soon to judge fault especially on something like this.

    Box junctions. These have criss-cross yellow lines painted on the road (see 'Road markings'). You MUST NOT enter the box until your exit road or lane is clear. However, you may enter the box and wait when you want to turn right, and are only stopped from doing so by oncoming traffic, or by other vehicles waiting to turn right.
