Scam or not, there's nothing you can do, or indeed nothing you should do, that's why you pay the insurance, they'll sort it out, so don't worry about it.

But you can at least highlight your concerns. As the "guilty" party in most instances of rear end shunts, if I felt it was sraged and I was being conned out of increased premiums etc I would not be too happy.

I have experience of a bogus claim for whiplash (accident was my fault although they did hit brakes harder than they needed too) but the person I hit at a 45 degree angle at very low speed was just a chancer and because their claim was below £2k my insurance company would not fight it. C'est la guerre!

Car 1 wasn't part of the accident, if car 2 didn't touch him.

    Here speaks the expert.

If car 2 braked because of car 1 then car 1 is involved. The road traffic act clearly states this. Be very careful when idiots like this give forum advice.

My OH has called the insurance company and they have taken the other blokes details as 'information only' at this stage, and will now wait for him or his company to contact them to arrange repairs etc. OH wasn't injured, so we're just going to have to wait and see what happens next, but hopefully the insurance company will handle most of it.

    There's always one.
If you can back this up go on, otherwise learn a few manners.
And if you can't, I would sadly be forced to agree with your advice in your last line.
