Redundancy whilst on maternity leave

I to have been made redundant whilst on maternity leave. I have worked for my employer for two years and have favoured for a new starter!! It was a scoring selection criteria like yourself used. I was not made aware of any of my rights and i felt the reasons used to determine me as the one to be made redundant were unfair.

I have also had to apply and be interviewed against others for new vacancies. However, i decided to investigate my rights. Through a conversation with Acas i found out that i SHOULD NOT OF had to apply and be interviewed for these vacancies. Regardless of that the other sare also redundant as i was the onky one on maternity leave i have more special protected rights. The law infact backs up this information.

In regulation 10 of the Maternity and Parental Act 1999. I also spoke to the Equality and Human Rights Commission whom were extremely helpful and actually sent me this information via email and post for my records.

Just be aware you only have three months from the date of your dismissal to proceed to an industrial tribunal, my work claim they consulted solictors over the whole redundancy process and re-struture. I have now asked for their so-called legal advice to be sent to me in writing. I wait with baited breath!!
