Advice needed re excess on car crash

I had a car accident on 1st Dec 2008 which wasn't my fault. The man admitted liabilty at the scene to the police. It took along time between the 2 insurances for the other partys insurance to finally admit the liability. Nearly 5 months on and ive still not had my excess back £250 and really could do with it now with the times as they are . Ive contacted my insurers (3 times since begin March) and they have contacted the others insurers whilst i was on the phone and they keep saying they will send it that day to my insurers.(my insurers say they turn it around straight away). It's been 2 weeks since the last call and no ive still not got my chq. Where do i stand? Getting about fed up with it all now and it wasn't even my fault.(but feel like i'm the one getting punished).
Can i ask my insurance to go legal on it?

    You could issue a summons to the other driver using moneyclaim online?

    I personally would ring the other Insurer, ask for the persons name at the start of the call and be polite. Ask them to send the cheque for your excess and ask how long it will take before you physically receive it. Then advise them politely that you will ring them back personally a few days after that time has elapsed. (Make a not of the name and date / time you rang)

    You would be amazed how frequently this gets the cheque sent out within a couple of days.

    They should be doing it but they are often not very efficient at doing it, a simple polite call yourself will often get it sorted out there and then. Its a simple trick brokers use and its amazing how often it works, its far more effective if you are polite and take the persons name
