    You are absolutely entitled to insist he take this down the proper insurers route if you have the slightest suspicions or concerns. You may of course offer him a private arrangement as a courtsey but he has absolutely no right to expect, insist or try & bully you into it. If he tries it on, make this very clear to him.

    However, if the police are involved, there may well be the possibility of a number of charges and your property damage might be an evidential matter. I don't know what the law would make of her father doing the repairs?

    In a situation like this, I would tend to the thinking that this should be kept as above board as possible & then some - I think I would be taking the insurers route and be getting quotes off a number of other builders.

    I would just go through the insurance route as if you don't you will just be storing up problems for a later date. Make sure you have a witness and photographs of the damaged wall and car.

    I don't think that you will have to go through your house insurance unless the claim gets tricky or the girl says that it was your wall that jumped into the front of her car.

    Get two or three quotes and give the father the option of paying you cash, if he doesn't come across in one or two days then file the claim. Don't be bullied and remember you know lots of builders yourself that would carry out the work for you. Oh and remember to keep a log of any reasonable expenses incurred as these can also be part of the claim.

    I really love the fact that some people can try to make you feel guilty when you had nothing to do with it.
  • The fact is the first half of your post is irrelevent. Do you have any proof of wrongdoing? ultimately not so the police will do nothing.

    Re insurance. You are free to claim, however, you may find things easier if you do go with the agreement. Maybe call express your concerns, ask to see proof of his credentials and if you are then happy state you will only agree to it if its done as a priority and he gives a written guarentee of the work.

    Actually they are not required to provide any insurance details. I see no mention of anyone being injured.

    This does not make sense, you mention he gave you his daughters insurance details and advised "who" would be in touch. If he has given you the Insurance details and advised you her Insurers will be in touch then it would indicate they are going though the Insurance. He then tells you he does not want to go through the Insurance.

    If you go through your own insurance you will have to pay your policy excess which is probably £50 or more. This can be recovered from their Insurance company at a later date (Until you recover this or your Insurers recover their money your renewal premium can temporarily increase).

    I would suggest you obtain two quotes from local builders, this ensure the price you get is competitive. In addition they will normally advise you of exactly what work needs to be done and any problems. If you do decide to get the father to do the work you can then use this information to talk through and ensure he is doing the job properly.

    If you were my client I would recommend you go down the Insurance route as if there are problems with the work you have some come back. I personally would ring their Insurers, if they have reported the claim to them they will normally instigate the claims procedure and ask you for the two quotes. Depending on the cost of the quotes they will either say go ahead with the cheaper of the quotes or may want to send a loss adjuster out to inspect the damage before they authorise the work. (Its normally best to avoid using the Insurers recommended builders). If you go down this route you will not have to pay your excess, the claim will not go down on your policy and their Insurers will pay for everything.

    The alternatives are the above method but use your own Insurers but as stated you will have to pay your excess. Or get him to do the work but as with any builder you may have problems eg the quality of the work or him taking a long time to do he work. If you use him and have problems it will be you against him rather than it being their Insurers or your Insurers problem.

    It sounds like the laurel hedge was overhanging the path and/or carriageway, obscuring the poor girl's view of the road ahead.... The thoughtless homeowner is lucky the driver's injuries were not more serious.....

    personally i would get some qoutes and pass them over to him to pay cash dont get him to repair it

    Definitely don't get involved with a private arrangement. Who will you turn to if the job is not up to scratch?

    Follow the advice already posted - get two quotes from local builders, making sure the one you want to do the job provides the cheaper one. Also get quotes from gardeners to put your garden right. Then send them to the drivers insurance and ask them to confirm they will reimburse you as their insured was responsible.

    No one was injured, it's a reportable accident as property was damaged but as there was NO injury there is NO requirement to provide insurance details. Go and READ the road traffic act.
