council tax refund

Sorry if this is the wrong place to post as i am a bit confused as to where this query should go, in a nutshell i have won my case and my council tax is going back from an E to a D, I have lived here for 12 years and had a letter to say that i would get back about 2600 pounds, but the council want to keep the whole years payment for 2008 to 2009 even though i have always paid monthly, and they even kept back another 239 pounds so that i was in " credit ". Can they do this or am i entitled in law to have the whole amount refunded after all it is my money so to speak? RayH
