Advice Please - first time seller

I have recently instructed an estate agency to market my property on my behalf. As part of the arrangement, i have agreed for them to be 'Sole Agents' for a period of 12 weeks.

However over the weekend an old work colleague of mine has shown great interest in the property and i would of course rather sell to him at a price we have discussed without going through the Estate Agents. (he came direct to me and was not in anyway introduced via the EA)

Do I have to wait until the 12 weeks are up before i can sell to him?

    Do they have sole selling rights or is it just sole agents? If it is just a sole agents clause, then you should be ok for selling privately, although I would beware of them charging you a withdrawal fee.

    How did he become aware that you were selling the property ? If it's because he saw the estate agents sign outside or was it advertised in the paper then I suspect the EAs might try to argue that they should be entitled to something ....

    As an agent if you came clean I would, at this early stage, agree a special lower rate (for your mate) and would insist I saw the sale through but still keeping on the market to get you back up if your mate pulled out.
    A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.

    I believe i just agreed to sole agency and not sole selling rights - am just awaiting my copy of the terms in the post.

    He became aware of the property through speaking with my wife, he didn;t even know we were looking to sell.
