Not sure if this is the right place, B244 notice from land registry?

I'm not sure if this is the right place to ask this but my parents got a B224 notice from the land registry about a mistake on the land registries documentation, and their intent to correct it.

The mistake in question is that their documentation shows my parents house owning the pavement in front of the house.
This is not under any dispute as it's an obvious error and my parents own documentation shows the LR's existing docs are wrong in the regard (so the proposed correction would bring them in line in that regard).

However what has got my parents a bit worried is that according to the plans the Registry diagram included show, part of my parents garden (albeit a small part*) is not theirs - basically one corner is chopped off.
This is different to both the original conveyance of the house (drawn up in the late 60's / early 70's), and the amended version from when my parents bought the house in about 1974/5.


Does anyone have any advice?
We're going to ring the LR come Monday and see what they say, but I'm just wondering if anyone else has had a similar situation?

I'm guessing it's possible, looking at it that they've bought together two different entries for the LR, or a paper copy was damaged and they've basically guessed where part of the boundary is (it looks like they've drawn a straight line from adjacent house and used that as the boundary).


*A triangle probably about 2 meters on it's long side.

    Is the part of the garden that's been "chopped off" on the land registry papers enclosed with the rest of your parents garden (eg by a fence or hedge)? If so, based on the length of time that your parents have "had use" of that particular piece of land they would be able to claim possession of it anyway.

    If you have access to a colour photocopier, and access to the conveyances of the 60's and 70's, take copies of these to send to the land registry to back up the phone call you make on monday.

    If the land registry tells you anything that worries you further, please feel free to pm me and I'll try to help further (I'm a property law student) if not, contact a local solicitor and ask if they do a free inital consultation and take the papers along and get some further advice.

    Aye the garden is fully fenced in, along the same lines the original developers had, and the original concrete posts are still there, although my dad stopped using them almost from the word go (he put his own in on the same line/just inside the boundary when he replaced the original barbed wire with wire mesh type fencing that needed more supports).

    It's not a case of adverse possession (or shouldn't be), as it's always been fenced off, and is shown on the original developers plans, and the conveyance from when my dad bought the house as belonging to the house, but rather it looks like someone has updated the records incorrectly, possibly bringing different parts together and guessing at where the boundary line should be?
    It looks like they've assumed it's a straight line from one of the houses built later, despite the fact that there has never been any question with the neighbours about it.

    These pics might help a bit, the first is the original conveyance from the developers (or rather a photocopy of it), the second is the one from when my parents bought the house*, the third is the one the land registry enclosed with their letter (the amendment they want to make is the blue bit, which we totally agree with).

    It's only a small bit of land, but it's the potential hassle that's got my dad worried :)

    *It's a slightly different shape to the first due to the original owner building an extension that went slightly over the boundary, and the parents having to buy that bit of extra land.

    Might be worth taking some photographs of the piece of land to email over to the land registry with copies of these plans - they're usually pretty helpful, but let me know how you get on!

    Hi

    We rang them up Monday and got a helpful guy on the phone, basically we've got to send them a letter saying we're happy with the amendment they've proposed but have an objection to the error in the corner, and include the plans they sent with the area highlighted, and a copy of what we've got.
    They may need to send someone out to confirm it, but he didn't think it would be a problem either :)
