I think Crazy Jamie has explained this very clearly.
I can't see how any court would apply "something like the Gillick case". It is negligence.
How can the Defendant have a finding of contrib. against them? It is pleaded in Defences as "further to, or in the alternative".
I think the poster has muddled the issues here.
I can't even be bothered to explain anything else as CJ has done so instead!0
