removing charges held on my mothers property

My father passed away in march 2000
Before he died he ran up some debt being as he was unable to work the bank BARCLAYS forced him to get my mother to agree to remove her matrimonial rights to the home and a builders store and he was made to pay £40 per week till the debt was clear that was in 1995 my mother had been paying this up until 2008 when she was advised after investigation by a friend that barclays bank could find no documents to show that she had had independent legal advise before signing anything so therefore
barclays had no rights to charge her ..they also refused to let her know the outstanding amount owed and had great difficulty in finding basic information from barclays credit recovery dept
The thing is she would like to know if she can recover her deeds to both properties so as to sell them and move to a smaller bungalow as she is now in her70s
any help would be apprciated as both my Mother and I feel there may be some clam here

Your post is not very clear, Barclays could not have actually legally forced her to sign away her rights. Your father & she should have taken legal advice, especially if they felt that pressure was being put on them by Barclays.
If your father had debts, but also left assets, then the debts do need to be repaid from the assets after the death of your father. But that shouldn't include the house that he shared with your mother. The business would be another matter, unless of couse your father put the house up for collateral against his loans/debts before he died.
What she needs now is proper legal advice, not just advice from people on a public forum. If she is on benefits, she should qualify for legal aid.Also some solicitor's do offer a free half hour consultation.The bigger the bargain, the better I feel.
