HSBC refusing refund

Hi
Can anyone tell me if HSBC are within their rights to refuse a refund for fraudulent use of my card. I had 2 instances of use, 1 of which they agreed to, the other they haven't. It was for £52 for an online booking at a restaurant. They said that"The email address and password are set up in agreement with the retailer" therefore they have no recourse against the retailer.
Can they do this?

I'm not an expert in this area but it sounds to me like they are fobbing you off (and this happens SO often).
Whether they have any recourse against a 3rd party is irrelevant to their contract with you.
If they accept your card was used fraudulently (which the other transaction implies) then I think they will have to honour it.
Start going through their complaints procedure.0 -
Have you spoken to the restaurant to obtain the log in details used on your card?0

Just done that Norman - don't think they will give me info though because of data protection act. Will wait and see.0

Best start a formal complaint in writing (preferably) to give it more creedence and sit and wait for a formal response and then a final response after 8 weeks.
If the final response isn't satisfactory, go to the FOS (ombudsman) with your complaint and let them decide on a course of action.
You HAVE to follow this procedure with all financial disputes.0
