    Evening :) Hope everyone's well :)

    I don't suppose we have any experts in Scottish Education Law lurking tonight :rotfl: Its a long story and I won't bore you with the details but our youngest daughter has been refused a place at the school her brother goes to. They want her to go to her catchment school in the completely opposite direction. I am at my wits end with this so I was just wondering if anyone had any experience in this, and in Scotland ????? Have tried posting on the Scotland board but no takers as yet :(

    You may lodge an appeal and your appeal will be heard by an independent council appeals committee. If you are not provided with a decision on your request by 30 April (or within 2 months for requests made at other times of the year), you may also appeal.
    Deciding whether to Appeal

    You may be very disappointed that your child cannot go to the school you want, but you should have a good reason for asking an appeal committee to look at your request again.
    Before you decide to appeal you should consider these points:
    • Do you agree with what the council have said?
    • Do you think what they have said is allowable?
    • Have the Council’s guidelines been followed?
    • Would it be more advantageous to apply for another school at this time rather than appeal?
    More information on appeals and alternatives may be obtained from the eEducation Department.
    Your appeal should be sent to the Education Department. You will know the reasons why your placing request was refused and you will be given the opportunity to explain why the authority was wrong to refuse your request in person or through a representative, whichever you prefer.
    If the appeal committee refuses your request, you have the right of further appeal to the Sheriff other than in the case of early entry requests, where there is no opportunity for appeal.

    If lea is the ed auth then its West Lothian. We've made the appeal based on
    1. her brother is at that school,
    2. her nursery feeds that school and all her friends are going there,
    3. we had two of our other kids (now at high school) at the catchment school and one was so badly bullied then beaten one day he ended up in hospital, later we discovered the school had no record of any incidents involving our son. So we refuse to send any of our kids there.
    4. It takes 40 mins to walk from one school to the other and that's how late she would be in the morning getting dropped off and how late I would be picking her up at home time.
    5. She doesn't know anyone at the other school, doesn't know the school at all and knows the school I applied to really well.

    That appeal was refused on the grounds that if she was added to the school role they wouldn't be able to hold open the reserve places they should for any kids moving into the area.

    They arranged an appeal committee meeting for 21st May. It was being held in a neutral venue in Bathgate. We were told we could bring up to 3 reps with us. But the letter telling us this only arrived on Wed and we had till noon yesterday to tell them if we were bringing anyone with us. So I phoned to say no, we would be unrepresented. We got a letter from them today saying the venue is now the West Lothian Council buildings (hardly neutral ground) and they enclosed a map of the area showing a walking route from our house to the school we were applying for that would take about 30 mins to walk, whereas we don't go via roads, we go via footpaths and takes us 5 mins. They had drawn a route to the catchment school using the footpaths though, showing it takes about 10-15 mins by foot!

    Sorry to bore you all with this but I don;t know what to do next. I know that the appeal committee is going to just run over us. The chair is a guy who was the ed auth's head of customer care until a couple of years ago (hardly unbiased). He's going run rings round us. The CAB were no help and just said sorry, other than give me the info PP has given me above they couldn't do any more. PP you posted that in a few mins, it took the CAB 3 days to send that to me :)

    Thats shocking TMK and typical education numpties that families cannot even go to same school.
    Have you called education department etc then write letter then if all else fails I would go to local paper or threaten them with that first as how bad will they look when brothers and sisters cannot even go to same school.

    Are you wearing,jacket shawl? I would get nice shawl out of debenhams or somewhere to wear during day and then at night take it off.
