advice please with house buying after iva is settled (completion certifcate pending)

Hello there, im a new one here but could do with some advice, i have last month settled my iva with a full and final offer to the ip, this went to the creditors meeting and was accepted, i am yet to receive my completion certifcate, this is where i get concerned though, my nan has now offered to buy me and my brother property, however my biggest concern is the property will be brought by us and she will give us the money to pay for it, very lucky man i know but i wonder will any of my creditors have any claim over the property even though it is settled but i dont have my completion certificate (my nan doesnt know about my iva and would ideally like to keep it that way)

    You need to ask your IP but after my IVA F&F was agreed I was told " thats it anything you get now it yours" It has been agreed and just a case now of your IP getting the claims in and paying them.

    It can take a few months for your completion certificate to be sent, took mine 8 months as IP had to chase up a few creditors for their claims.
    TOTAL 44 weeks lose. 6st 9.5lb :T
  • thank you i have spoken to the ip's assistant (ip was not available) and i asked that in theory if i was to receive some money now would that be ok and would i have to pay any more into the agreement and she said no its all complete (i didnt know whether to say im getting some money and i am buying a house just in case they got funny)

    thats sounds about right , in the 8 months from F&F agreed until I got paperwork at no time did IP ask for any details or did I give anything , payments stopped and it was just a case of waiting. Someone else may be able to help but realy your IP is only one who can really advise.

  • thanks for the replies, i just checked the paperwork i received so far with the receipt for my f&f payment and i have a letter stating that the iva has been succesfully concluded and no further payments are due, i suppose really i am just looking to make sure i can make a good start of it this time as i know my grandad would be turning in his grave if he knew the mistakes i made, and i vow never to make the same mistakes again, everytime i think of getting credit in the future i will just think of him!

    Hi grimreaper - its nice to hear a happy ending. I'm happy for you that you have completed your IVA and wish you well for the future. If it was me I would feel confident with the letter you have stating the IVA has been successfully concluded and no further payments are due. Sounds like you can put this all behind you now.

    I would give it a month and then check your credit reference file to make sure everything is in order and if not to clean it up. There is a link how to do this on the BR guide sticky.

    Oh - forgot to mention why don't you look on the individual insolvency register and see if they have changed your status.

  • thank you fyp, i have had a look at that register and it still shows current at present but to be honest from other peoples experiences it seems it could be a while to sort it out, the other thing is the debts were all unsecured anyway so i dont see that i could be forced into repossesion or having to lose equity in the property anyway could i ??
