Please help with RBS question

Just wondered whether anyone would be kind enough to advise with reference to the below.

Last year I opened up a Royal Bank of Scotland account. I wanted to use this as a billing account and set up one Direct Debit to come out later that month.

Unfortunately I had some problems transferring funds and had to cancel the one DD that was on the RBS account. I was assured that this would be cancelled in time before the DD was to come out.

The DD was presented on the account and I was subsequently charged a sum of £38.00. I did not agree with this and spoke to several advisors as well as sending correspondence advising what I had been told. They have stuck to their guns and said that this needs to be paid.

Regrettably I have been ill for some time and have been in and out of hospital. I have sent correspondence and spoken with advisors over this period only to find they are not willing to waiver the charges.

Due to the DD problem last year have found that RBS are now sending me letters asking that I pay over £300 which has eminated from the DD problem and is based on rolling charges - one after the other as the initial one wasn't paid.

I called the RBS yesterday and explained what had happened - they are again not willing to waiver the initial charge and said the best they can do is reduce this to £95.00. I have asked whether I can pay this in installments and they have refused.

I realise now probably the best policy was to pay the initial £38.00 and perhaps I have been stubborn, but I felt that on principle that I should not have been charged initially.

I have advised that I will seek legal advice but I don't really know where I stand. I have never used this account only for the DD that was set up and cancelled.

I would very much appreciate any advice anyone can give. I feel totally exasperated after speaking to them so many times and not really getting anywhere.

    Get your first letter sent in to reclaim the charges which they are refusing to refund....put the account into dispute by complaining and ask them to stop hassling you over it with something like this....

    I would also like to make you aware of The Office of Fair Trading Code of Guidance in which it states: putting pressure on debtors or third parties is considered to be oppressive This includes ignoring disputes about whether money is owed and refusing to freeze action if the debt is in dispute.

    I used to work for RBS.

    The best thing to do is write a letter addressed to CRU (Customer Relations Unit) Explain all of your cirrcumstances ie been in hospital and can get GP to verify this etc etc. They were alway sympathetic with the way things were handled.
