Barclays cleared?

I put in a claim for charges on 04/06/08 for the previous 6 years (to 04/06/02). I've just been in to Barclays to let them know that I'm claiming financial hardship and that I'm putting in a new claim for charges from July 2001. The personal banker told me that Barclays have been cleared of any unfairness by the courts and will not be paying out.

Is this true and if not am I right to put in a new claim from July 2001?

    they so HAVE NOT ! what a crock of poo

    lol seriously they havent, barclays have taken themselves out of the FSA waiver on charges for charges incurred after august 2008. Theres been no test of fairness on those charges.

    Get your claim in for everything since July 2001 to NOW (including reserve charges and cancel your reserve if you have been duped into one) and don't be fobbed off.

  • I'll go to see him tomorrow and get him to clarify in writing. In the meantime, I've got some adding up to do from 2001!

He told me that the advice he has been given is that they have been exonerated by the courts on all counts of unfairness. I told him the REAL situation and asked him to put his advice in writing. He his mouth fell open for a moment and he told me there is nothing in writing as such, but this was what he'd been told.

    How many rightful claimants have been put off by this kind of bull****?

    Well done you for asking him to put his money where his mouth was :) Bet that felt good lol.

    Hopefully u will have made him think twice before blatantly lying to other customers.

    Hi Matt, before removing your Personal Reserve from your account, please take note of the following:
    if your account is currently over its agreed overdraft limit (and you have no availability to increase it) and within its Personal Reserve, removing it will force the account into collections, which may be detrimental to your credit file (unlike Personal Reserve) - I work for the bank, but please be assured I would not make any suggestions that would be of benefit to anyone but you.
    I've never been charged by any banks, but wish you all the best in reclaiming yours. :)

    I thought you could only claim for the last 6 years ??

    Apologies bankemployee but it is costing him £22 per 5 days. I would get rid of the reserve even if it puts it into collections. If the account is disputed, Barclays can't collect on disputed debts.

    FSA Waive includes a line about the stay period and limitations. ie 6 years from the date of the waiver or July 27th 2007(back 6 years)
