Barclays bank have refused my hardship claim. Can they do this?

From esmerellda and natweststaffmember's posts, you should claim ALL charges, but you will only get a proportion of the ones pre August 08 back as part of a financial hardship claim. The rest would go on hold till the end of the test case etc.
As you may be receiving a second letter from Barclays, I'd wait until the time passes for that to arrive (or not?!) and then write another letter to Barclays before trying the ombudsman.

I got a letter from barclays bank this morning with a budget sheet thing to write down my outgoings etc...
I think Esmerellda was right i think the first letters i got were in error.
so fingers crossed i will get a good result

I recall getting one of those budgets through from my first letter. When I say first letter I actually got 3 simultaneously all mis-referencing each other and didn't make sense. They were all automated as I had clearly stated I was in a DMP with CCCS in my initial letter claiming hardship and their automated letters all asked me to contact them if I needed advice on DMPs!!
Anyhoo, I am definitely going to dig out that correspondence and send the budget off as well.
We can do it in tandem and see if it gets us anywhere! It's worth a go..

I recently wrote my 1st letter of complaint to Barclays, sent the 17/05/09 & I today 28/05/09 have received 2 letters from Barclays. One advising my complaint will be looked into. The second basically what has been mentioned here.
Again though my charges go back to March 2008 & of 21 charges I am trying to reclaim only the last 6 are of the updated £22 (one £8) from the new terms and conditions.
Reading through this topic, I think I will give it a week incase I receive another letter for a breakdown from my income/outgoings then I will follow it up with the 2nd letter from this website.0 -

I'm not in a DMP but had a Budget sheet produced by them. I have a negative disposable income in excess of £1000 per month. I sent my request for repayment along with a copy of the Budget and a declaration of finacial hardship on 20th April and have received a goodwill payment of just under £1500 against my claim of £1900 plus statutory interest yesterday. No quibbles no third degree.

I received a reply to my claim this morning which says something like this:
As mentioned before , your complaint regarding unauthorised overdraft charges will be dealt with once the legal proceedings between the banks and office of fair trading are concluded.
should you be dissatisfied with the delay, i am obliged by our regulators, the financial services authority, to bring to your attention your referral rights to the financial ombudsman service.
My claim was due to financial difficulty at this point should i now take it to the financial ombudsman? theay seem to be fobbing me off0
