Hi , i have posted before - briefly I am now bank rupt as of 24.8.09 and my wife was also made bankrupt th 15.9.09 - however un beknown to us the OR has written to our water company and council tax to advise of our bankruptcy. the water company have written to us and said our account had been wiped clean and a new account had been opened - we werent behind on the water and was upto date but suppose its a technicality they have to follow so fine. The council tax however is a little more complicated - we was n't in arrears with them at the time of the bankruptcy and I made my monthly payment after the date of my bankrutpcy not thinking anything of it -but before my wifes bank ruptcy -we have then received an amended councul bill detailing the remaining outstanding amount and they have adjusted the monthly payments and the monthly payments have increased by 12.00 - when i queried this they said that they couldnt credit the payment i made after the bankruptcy and have put this payment into a holding account for when the OR can claim it themselves if they want to - this means the bill is now higher than expected and hence why the payment on a monthly basis has increased is this right? I have requested they credit my account with this payt but they willnt without the OR saying they have no claim on it - i spoke to the OR office and they were very flippant about it and said the local authority would have to write to them explaining the above- can i have some advise on this please thank you
I would do as the OR office has recommended.
Write to the local authority and explain the OR needs it explaining in writing from them and also send a copy to the OR office to show you have done as they requested.

Hi i`m not sure if anybody could help me but my friend has just split up from her husband & has found a place to rent.They are going to have to go bankrupt very soon but she is concerned as to how she will buy furniture etc for her new house. She will have her 3 children living with her. Does she just buy everything that she needs & put it on her credit card? If she does that when they go bankrupt will it all be taken off her as she`s brought it all with her credit card? Could somebody help please?

Hi there.
If she's made the decision to go bankrupt, I would advise against using further credit to fund buying furniture for her new place. The official reciever may question the fact that she's spent money knowing she's unable to repay it.
If she were to, it is unlikely to result in the furniture being taken away, it could leave her with a bankruptcy restriction order meaning her bankruptcy could last much longer than the normal 12 months.
If she hasn't already done so, she should refrain from making full payments to her creditors and try and use what money she has got left to fund getting the new things for her home.
Alternatively, she could try looking at Freecycle. Whilst it's not ideal, she maybe able to kit out her new home for next to nothing. Once she's back on her feet again after the bankrupt she maybe in a better position to be able to get new stuff.

Bankruptcy is an individual thing...they stopped "blacklisting" addresses a while ago....unless you have any joint debts with your parents then they will NOT be affected

I just wanted to know if I keep paying my debts up until my bankruptcy loaning money off friends would my bankruptcy still be accepted. I would still be living with parents would this have an effect on my bankruptcy or my parents.
I have not defaulted yet due to friends giving me money but will when they stop and would like to declare bankruptcy when I know I have no more options.

Make sure you pay your PRIORITY debts gas/electric/water/tv license/council tax all other payments credit cards/loans just stop paying...bankruptcy is a VERY LAST option and isnt the easiest way out some people think...again though once you do go bankrupt then it will have NO effect on your parents (unless you have any joint debts with them)

With my living at home and on JSA Job seekers allowance of £64.30 I pay my parents £30.00 a week.
Is that still ok if I go bankrupt then I have ten pounds a week mobile and £15 travel looking for Jobs leaves me about 9 pounds a week to pay debts that is why I have been getting money off friends for my debt but that will stop. That is why bankruptcy is my best option just do not have the money for anything else.
Do you think if I go bankrupt the official receiver will want much off me a week?.

Once your bankrupt your allowed living expenses..now if after everything is paid you have MORE THAN £90 a month left then the OR would take a percentage of (its called an IPA) this but going off what you've posted I doubt they will....if your sole income is benefits the OR's never impose an IPAWe all die. Thank you for your reply s did think I would get CCCS reply but you have been more than good. I have been told that I my not have to pay the full £510.00 to go bankrupt is this true and when would I find this out with me being on benefits would it be when I go to file my bankruptcy forms at court or at my hearing at a later date.
