Hi
I just wondered If I can't file for Bankruptcy if I have not kept my reciepts (shredded in shame)?
Also what if everyone in our family has the same innitials, will it cause problems for them as my partner is a Director of a company?
Thanks for your time.0 -

I would like some advice of my current situation. My husband was made bankrupt last year. He owes the bank £74,000 (an overdraft which has £13 a day interest) a company £4400 and trustee £27000.
I received a letter from the trustees solicitors start of the month which notes without prejudice an offer to settle his bankruptcy for £20000 if paid within in 60days, we can not afford this unless we sold our endowment policy from our mortgage (which i am not sure the bank would be happy to do), our endowment is currently worth out £21000. If i did this i would be able to sell my own home rather then the trustee selling it.
My house is valued at £350,000. The court are only able to take my husbands share of the house (i would be left with out £100000).
When i was sold the mortgage i was not given legal advice on the all monies mortgage so there is still questions over the legality of the mortgage – I would rather settle out of court then go through the lengthily and costly process of a court case and not know that we would 100% win.
Is it wiser take this case to court or negotiate with the bank to settle out of court and be able to sell the house myself.
Any help/advice would be greatly appreciated!!!!
I’m not a 100% sure of this to be honest, I will pass your post onto our Bankruptcy Support Team and get back to you as soon as possible.

Thanks for the response. Giving the my BR number is OK if I know they are coming, But how will I know if they have applied for a warrant ?
Thanks
You would need to speak to your lender to see if that’s their intention/ or if they have passed the debt on to the bailiffs.
Hope this helps

Hello,
This Official Receiver will go through transactions with you if needed.
If someone in your family has the same initials, this should not cause a problem as it can be proven that you are different people.

Hi
I hope i'm posting in the right place. Ive been taking lots of information in for the past few months of what is best to do.
CCCS advised my best option is BR. Which i fully accept. I have a few problems with that at the moment as it may affect my future employment which hopefully will be changing late this yr or early next year. I have already contacted the union of the employment who said it doesnt appear to be a problem however I dont want to take the chance.
So im wanting to do a DMP in the meantime..
I wont be in the UK for the next 2 weeks and ideally want to get this started asap. the stage i'm up to is I have a new bank account set up and have transferred my income and rent. is it OK at this stage to cancel my direct debits even though I have not yet set up my DMP?
ive had my paperwork sent by email from CCCS so they've already assessed what my payments would be? does this mean I can start this asap or do i have to do anything else?
Thanks0 -
I am not sure if anyone will be able to help me. My husband and I are on DMP. We owe over 40k. We also have 110% mortgage and are in negative equity. I am currently on maternity leave, but if I go back to work I will be able to pay 1/2 of the mortgage and my debts without DMP. My husband is unemployed and I don't think he will be able to pay off his part of the mortgage and his debts. Please advice what would the bank do with the house and his part of debts? Will I be responsible for his loan and CC? I know it may sounds funny, but I really have no idea. How can we sort this out if my husband declares himself bankrupt?0
