    A shortfall on a property can be included into a person’s bankruptcy. If only one of them went bankrupt, the other person would become solely responsible for the debt due to joint and several liability.

    It would all be down to keeping things separate. So if you don’t have any joint accounts or apply jointly for credit your files would stay separate.

    I am just starting the process of going bankrupt, having been to the CAB for their advice.
    They gave me a template letter (they don't have time to help more, although I did ask them to represent me :(), and told me to write to everyone to make token payments as the first stage.
    I've just sat down with all the paperwork, and find that I've got so many letters from debt collectors (I've got 3 different companies just from one debt, and only been suffering problems with paying for 4 months!!! Let alone all of the others!) that I just don't know who I'm supposed to contact.
    Do I just write to the original credit card companies etc., or am I supposed to write to the debt collectors too? With the same letter? All of them, or the most recent ones (no, no letter informing me who is managing my debt now)?
    I'm totally despairing, and not coping at all!
    Really hoping you can help!

    First you are doing your best to try and sort out the situating, so no one can ask any more from you.

    I would suggest sending the letters to the people who contacted you most recently. If they respond and say they are no longer dealing with it, they should advise you who is dealing with it now.

    I have twice today given my personal email address and mobile no. for a member of your Bankruptcy Team to contact me.

    What is the normal waiting time to receive a call/email from them?
    I have sooooooo many questions to ask before I make a final decision.

    Sorry about the delay at the moment. Our bankruptcy team also deal with DRO so at the moment they are extremely busy. If your information has been passed on, it is unfortunately a waiting game of dealing with people in order of contact but they will get around to you.

    A lot of creditors issue a SD with no intention of following it through as this could be just a scare tactic. If you had sought advice already and been advised that BR is your best option and if the SD goes through, this could save you the cost of going down this route yourself.

    Thank you for your reply.

    I have posted my budget.

    The £200 is what my son pays who is working but he is on an apprenticeship and doesn't earn that much.

    My other son was made redundant in March so does not contribute.

    I have a 70 round trip to work everyday, which is why my petrol bill is so expensive, but I cannot afford to move nearer to my work and if I did my son would not be able to afford petrol to his work.

    I would appreciate your thoughts on my budget.

    I did have advice from a solicitor in January concerning the joint bills with my ex and he advised I should go bankrupt, I also spoke to the CAB and they advised the same. It has taken a while for me to accept but now I'm resigned to it.

    I'm scared to death tho that things are going to get even worse.

    I would appreciate any advice you can give.

    CRB checks will not show up bankruptcy......IF they ask on the forms have you ever been BR then you would have to say yes

    Thank you for your reply. There does not seem to be any major issues with your budget. There are a couple of areas that could be tweaked i.e. your medicines and prescriptions – you could maybe look into a pre payment certificate, I have attached a link to their website, as this would save you a little bit of money every month http://www.direct.gov.uk/en/Dl1/Directories/DG_10011173

    CRB is, as far as I am aware for criminal offences not to do with credit, so I can’t see it been a problem as going bankrupt is not a criminal offence.

    I ahve been in contact with the cccs and have been advised to look at going bankrupt - when i spoke to the councillor she said that if i was to go bankrupt that it would not be announced in my local paper and would only be announced in the london gazzette and on a online site, however i have since looked on various sites about going bankrupt and the majority state that it will be announced in my local paper.
    What i need to know before making my decision is will it go into my local paper or not ??
