  • Thanks for replying blind-as-a-bat. The firm we have our IVA with is Beesley and Company.
    I got in touch with them today and they are allowing us another couple of weeks to seek legal advice. I have asked if we can extend our IVA over a longer period of time and they are going to work out some figures. I have to send them our Income & Expenditure form and also they have asked us to confirm how much we feel we can pay each month. At the moment we are paying £575.00 per month and also 50% of my husbands overtime. Because we have missed some payments they sent us a letter allowing us so long before they would press for bankruptcy or pay £827.00 per month as well as the 50% of my husbands overtime to make up the missed payments.We could not possibly afford to do this! Our iva practioner also mentioned that they also have another client in a very similair situation as ourselves and confirmed that their park home was to be valued by the OR and would have to be purchased from the OR after valuation or they would be homeless... not sure if she mentioned this to be helpful or just to scare the life out of me... which it did!

    1/ should I take with me originals or copies of all my documents, or both?

    2/ if I have to take originals, do they copy my them while I am there?

    3/ if do they keep my original documents do they return them later?

    Was discharged in oct 2007 - have no debts of any kind now - how soon can i apply for a mortgage - not able to get a straight answer from any bank or building society

    Help please -

    1/ should I take with me originals or copies of all my documents, or both? You need 3 copies of the forms....1 for court 1 for you & 1 for the OR

    2/ if I have to take originals, do they copy my them while I am there? some do but will charge for the job...

    3/ if do they keep my original documents do they return them later? See Q1

    Do you mean copies of statements and loan agreements and that sort of thing?

    If so then you shouldn't need those. Just how ever many copies of the court forms that your court needs.

    Yes, that is what I mean, thanks Fermi. Also thanks to philnicandemy.

    But don't I need bank statements/crdit card statements etc for the OR? And does the OR need copies - will OR make copies or do I have to?

    (I found out, to clarify, that the bankruptcy forms 6.27 and 6.28 need each to be copied twice - one original and two copies of each form, as I had been confused by three copies. And before this I even wondered whether three of the same form had to be filled separately - I mean you have to get it right or you have wasted a visit. Anyway, it is clear now.)

    Affectively, you can apply for a mortgage the day after you are discharged from bankruptcy, whether you will be accepted is another question.

    As I'm sure you are aware it will still appear on your credit file for 6 years from the date of petition, which will affect the decision made by the lender. It's probably fair to say if you were to be accepted, you won't get the most competitive rates so you may have to turn in direction of a sub-prime lender.

    In order to apply for a mortgage without your bankruptcy having an affect, you will need to wait until it drops off your credit file completely.

  • Does anyone know what this means ?

    'The interim hearing be vacated ' ( At the County Court ) I am doing battle with a big financial outfit for a relatively small sum . I have legal advice in place but these letters always arrive on a Saturday which gives me the whole weekend to stew. Just tell me if its good news or bad ,but from past experience a creditor would not be spreading good news .
  • Hi There,

    Am in need of some advice.

    Have used the CCCS online tool...recommended bankruptcy, having weighed up the pro's and con's, seems like the best choice.

    My problem is that i dont have all the statements and credit agreements. I suspect some of my creditors have the wrong address listed for me, despite my attempts to change this, so havent been receieving statements.

    I have all the account numbers and contact addresses for my debtors and only approximate values for the actual debts, will this be sufficient? Or will i need to contact my creditors in order to get statements.

    If I do need to contact them, what would my best approach be? To tell them i am going bankrupt? Also, I have been receieving letters from Debt Collection agencies, should I use these on the the petition, or stick with the original creditor.
