It sounds like you would benefit from some free and impartial advice.
Any debts that are in your partners name will be seen by creditors as his responsibility. However, I’d advise looking as a couple at what solutions are available to you both.
If you petitioned for you own bankruptcy only debts in your name would be included in the bankruptcy, any debts in your partners name would be his responsibility to service.
I would initially look at the situation jointly (if you can) and then look at what debt solutions this presented. It would be useful initially to look at a joint household budget.
If your partner is not willing to look at a joint debt solution due to the possible impact on his credit rating you should give us a call directly for more advice.
If you do wish to work together then I’d suggest that the first thing to do is visit our online debt advice service Debt Remedy to help you find a solution to your debt problem quickly.

Thanks for the reply, appreciate the input. I tried contacting the CCCS, but they simply told me it will take me 20 years to clear and I should cut back on my outgoings to get there sooner, which missed the point I'm unable to meet my monthly outgoings. They also gave me problematic advice earlier in the year that has compounded my/ our problems. Is there an alternative, more reliable source I could gain advice from?

The other sources of help recommended are National Debtline or the CAB. Their contact details are in the first post of the sticky marked Look Here First: Bankruptcy Help.

Someone wrote on another thread they were quizzed about 'the incursion date' for credit cards debt, I've had credit cards for many years, don't know the dates I opened them, but the most recent balance transfers were about a year ago, so would this be the date I should write on the form?0

I would write an guestimate when you first received your credit cards.
Put the year then approx in brackets after and that should be fine.

My husband was made bankrupt in february 2009 and discharged the following year. He had a personal loan with Intelligent Finance with his ex partner which was included in the bankruptcy. Intelligent Finance are still pursuing his ex partner for the debt but because all the letters etc still have both their names on them she just forwards them to us. Intelligent Finance call our landline number to speak to her and although he has spoken to her to explain it is no longer anything to do with him it doesn't stop. Is there anyway his name can be removed off Intelligent Finance's correspondence as we just want to move on with our lives. I.F. are no help at all.0

You should write to Intelligent Finance and enclose details of the bankruptcy and request that your telephone number be removed from their systems. You should send this letter recorded delivery.
If the calls continue after this I would recommend raising a complaint.
I expect a large part of this is to do with Intelligent Finances internal systems and they may not be able to remove your husbands name from correspondence pertaining to his ex partner’s liability for the loan, but they should not be calling or writing to him directly.
Your husband’s ex partner is now fully liable for the whole outstanding debt.

How does a person go bankrupt if they cannot afford the cost of going bankrupt.
Person doesnt qualify for DRO as debt too high.
