i owe just over 5k on my barclays credit card
i am going to be leaving the country soon and this means my benefits will stop... even while getting these benefits i have not been able keep up with my minimum payments without not having enough for food etc
they have reduced the interest very low and i have a set amount of 70 a month its been hard finding a job i am being treated for depression and i am in esa benefits... what are my options? i really cannot see myself getting out this whole

Hi unsure100 and thanks for your post.
The Official Receiver will question this but an explanation similar to the one you have given here should suffice, you can even write it in section 13 of the bankruptcy forms.
The Official Receiver could go back through all your financial records should he or she wish to, and they may do this if they feel justified in doing so. However, they cannot do this to your wife as it’s your bankruptcy and not hers.

I have a couple of more questions please,
I want to get repossessed (my house is a millstone around my neck, massive mortgage, partner no longer contributing as she has left).
Should I go bankrupt at my current address where I am still living? I will be in around three months of arrears by then. I dont want to tarnish my wifes address with a bankruptcy.
Also her mortgage company is one of my creditors - will that be an issue?
Could i go bankrupt and still voluntary repossess after, or could the official receiver vr on my behalf (but before discharge?) The last thing I want is for the interest in the house to be vested back to me in three years.
I am still managing (just) to pay my other creditors - should I stop that now?

Apparently, I am to be automatically discharged from BR today (hoorahh!!) exactly 12 months after being declared by the court. I have not received any notification from the OR or anywhere and don't really know if I am supposed to.
Is there a check list of things I need to do once I am auto discharged?
Will I get any notification of it?

As it is automatic and happens anyway the OR will not send you confirmation of the discharge. Either give them a ring and ask if they would be kind enough to send out a letter to that effect (some charge a small fee.)
Or you can get a certificate from the court you went BR at, I believe they charge around £70 for this or free if you are on certain benefits.
Or print out a copy of your page from the IS site when it changes over to discharged. The entry will drop off the IS site after 3 months so get it done fairly quickly.
After all that wait a few months and then start on the Credit Reference File clean up. See the sticky for instructions on this.

Hi,
I currently owe around £35k to about 3 different creditors.I haven't made any payments since about 2007 and have moved several times so they don't know my whereabouts.
I've heard that after a certain time period,if they can't find you,the debt is written off.Is this true?
How would this affect any future credit?
If this is not viable would bankruptcy be the best option?
I explored the possibility of an IVA when I was with my partner but the payments were ridiculously high so decided against it.
How would bankruptcy affect any future credit?Would it say mean that if I went for a mortgage in the future I would pay a higher interest rate or perhaps not even get one?
Any help greatly appreciated...

Hi,
So i've spent the last 32 hours locked in my house, armed with my computer a notepad and pen, a shedload of unopened post and a very large pile of red and threatening lettersSuffice to say it's as bad as i thought it was! £30k approx in debt! I run my own dog & cat grooming salon and have done so for the last 4 years, i have 16 year old twins also. My ex partner (whom i'd been with for 16 years) did the dirty big styley on me 2 years ago and it's still affecting me now, emotionally, mentally and physically but especially financially! My very sick father is also the guarantor on my business premises and the weight of this is becoming a very heavy burden to bear
The logical me knows that bankruptcy is probably the best option for me, i really am at Code Red as i've managed to avoid properly addressing if for a year odd. However the stubborn and proud me who has never quit, still wants to hold on.....I also have a HP car that i have 19 months remaining on but have put a lot of money into it approx £3k since it transferred from the exes name to mine, so i really don't want to lose it. Because i'm self employed and it's all so complicated and messy most people struggle to help me! I will be calling yourselves and Business debtline on Monday, but meanwhile what do you think? Thank-you, this is my first day on the forum

Hi Sarah and welcome to the forum
Well done for addressing the problem – facing up to it is the first step to becoming debt free.
It’s difficult to say what your options will be but you’ve already mentioned that you’ll be giving us a ring today anyway. We are only able to deal with any personal debts but Business Debtline will be able to advise you on any business related debts.
As your father is a guarantor, he would be liable for any debts that were written off through bankruptcy - but it’s best to get some tailored advice before jumping ahead.

Can anyone please advise i have recived a statutory demand from 1st credit to make me bankrupt and force me to sell my jointly owned house due to an outstanding debt for £3,899.22 owed to bank card i offered a repayment plan of £50 per mth which they point blank rejected saying they would only accept £130 per mth now recived in post the demand for full payment or they will apply to court to make me bankrupt can they do this as i offered to pay the max i can afford HELP PLEASE0
