Hi my husband went bankrupt on the 2nd of march 2011 we had a large electric bill £1500 we didnt out it on as we were told we would be cut off by edf ? we asked for helf from the edf trust fund they said they could help but have now let us down can we add the bill we had upto the 2nd march when we went bvankrupt and will we be cut off or could i have a new account from them in my name ? please any help would be great jenny:)hi i seem to be kindly getting replys but i cannot seem to find them must just be me having a very blond moment ha ha0

hi there, we will prob be getting house repossessed very soon, as this will involve shortfalls and other debt after will also prob have to go BR! main concern at moment is where to live, anyway as the mortgage and big debts are in both our names does this mean OH and i will have to go BR together or can just one do it? OH has other things like credit cards etc...been a big black cloud for past year and half not knowing what to do....thanks0

Hi, please can one of the advisors answer a question for me. If a property which is included in a BR is repossesed and sold after the bankruptcy, does the credit file have to show my discharge date as the settlement date or the date of sale of the property? I understood it was the discharge date, I wrote to the mortgage lender to ask them to correct it and they have written back and refused saying the settlement date is the date of sale no my discharge date.(almost a year difference) Thanks0

Hi, I was wondering if anyone could shed any light for me-I'm going to have to file for bankruptcy (I have spoken to CAB last year, but due to the unpleasant nature of the issue at hand have been rather effectively procrastinating for some time!)
I have 3 young children (aged 6, 4 and 3) and though their school is only about a 10 minute walk (though more like 15+ with them walking-my youngest walks ok, but he falls over ALOT as he is pigeon toed)
I do regularly use my car, and am worried about losing it in bankruptcy.
I have to do 4 school runs every day One finishes at 11:45am, the other has to be back for 12:30, and they have to have lunch in between that time, and once a week I have to do a 5th run at 4pm.
Plus I also use the car to drop the kids off to visit their Dad's family every Friday which is about 10 miles away-I know that everyone has the same issues, but I'm really worried about how I'd cope should I lose my car. My car is worth less than £1000 and I'm not working at the moment, as I always have one of the kids around at the moment(
Any information would be extremely helpful!

Hi Donna and thanks for your post.
If your car is worth less than £1,000 all you’d have to do is prove that using public transport for your essential journeys would end up costing you more than using the car.
I understand that the school is within walking distance but things like dropping the children off at their fathers and picking them back up would all be taken into account.
Nobody can give any really concrete advice on this as it’s entirely up to the Official Receiver that you deal with and your individual circumstances.
It is sometimes possible that a 3rd party such as a friend or a relative can offer some money into your bankruptcy to allow the OR to exclude your car, but this is at the Official Receivers’ discretion.

Hi Jenny,
At this stage, I’d recommend that you speak to your Official Receiver about this. They may be able to include this amount into your bankruptcy considering the circumstances but ultimately it is at their discretion.

When debts are in joint names you are both responsible to repay them. So when one party goes bankrupt the other party is still legally liable for the whole debt.
Before you take any further action I’d recommend that you contact us for some advice. We have a specialist bankruptcy team that could be of assistance to you.
To get in touch you can either use our online advice facility Debt Remedy, or ring our free Helpline to book a telephone appointment with a counsellor.
Debt Remedy will assist you in completing a financial statement which includes information on your household, employment, income, expenditure and debts. All this information is used as a basis to determine the options available to you to deal with your situation.
Once you’ve followed the process through and completed all the required information you will immediately be presented with an advice booklet, which will provide tailored advice for you based on your current circumstances. It will also provide advice on ways you may be able to improve your situation.
