At the moment we are on a DMP so we have no spare cash at all, but if by some miracle we can offer a small monthly payment are they generally willing to work with you or are they are bad as the stories I have heard?

    Income tax is a priority debt and needs to be paid as soon as possible.
    If you don't pay your income tax, or don't come to an arrangement with HMRC to pay off any arrears, the consequences could be very serious. They do have the power to send you to prison for non-payment of any arrears but this isn't common unless you ignore the summons.
    You need to call your debt management provider as soon as possible to do a review of your budget. It may mean offering a lower payment to your creditors until the tax bill is cleared.

    we (husband and I) are just about to start an iva - waiting for 'offer' to come through. just have a query about expenses and any additional income. my husband gets travel expenses paid by cheque and I'm hoping to do some additional work through an agency - appreciate that we have to make additional payments towards the iva because of the additional income but not sure how we would do it as it wouldn't be regular income. Also dont want to complicate things.

    could you please let me know the best way of dealing with this

    I would recommend that you speak to the insolvency practitioner who is dealing with your IVA.
    They would be able to give you further advice regarding this as they know your full financial circumstances.

    Hi I am 28 and considering BR I have £24k of debt from a previous relationship years ago, I am in abit of a mess as I have ignored it over the years defaulted and now its all catching up with me, I have a baby and a new partner and I am on anti depressants also with the stress of people tracking me down and writing me letters demanding money, I have tried the token payment and some have accepted but some have just added on more fees and now I own more.

    I am thinking I want to go for BR but as I havent been paying most of these creditors alot anyway as I defaulted I am concerned they will think I have too much free cash and they will take into account my partners salary but I really dont want to get him involved in all this as this £24k is nothing to do with him, and we have a baby together now so I just want it sorted.

    I dont want credit anymore or the stress of people coming to the door now I have a child.

    I keep hearing about an IPA how would this be worked out? and what would be my chances of being accepted for Bankruptcy, I think I will have around £200-300 remaining after all expenses, but my commitments would be around £1200 per month for the debt?

    Please advise, I really need the help

  • Hi, I was declared bankrupt 05/06/2009 and discharged 19/11/2009.
    My house was repossessed in Aug 2009.
    The council without my knowledge boarded up my house in May 2009 (prior to bankruptcy), but only sent me the bill in January 2010.
    I telephoned them and suggested they contact the official reciever and heard nothing more until today, when I have recieved a copy of the same bill and a letter threatening court action unless I pay within 14 days.
    Surely they cannot demand payment when the work was carried before my bankruptcy and without my knowledge.

    If you were to go bankrupt, then your income and expenditure sheet would need to show how much your husband was contributing to the household bills to give a true representation of how much you had left over after paying your share.
    If you have a surplus of £200/300 left over after paying your share of the bills, towards a debt of £24,000, then I would advise you to seek further advice as there may be other options you could look at rather than bankruptcy.

    It may be that the council have not bothered to contact the OR as you suggested.

    I would recommend that you contact the Official Receiver who dealt with your bankruptcy and ask for their advice regarding this.
