Hi there,
Just a quick question... I am claiming Incapacity Benefit and myself and OH were declared BR in march, we haven't got an IPA but I think we may be borderline as my OH has just had his pay increase. Anyway, I have a job interview in a couple of weeks, the job is for 16 hours which means I would be eligible for a Return To work credit of £40 per week on top of the wages IF I actually got the job...what I want to know is could the OR take that Return To Work Credit into account when calculating an IPA (assuming we have a surplus of £99) or would it be exempt because its from the DWP ? Hello, I have many questions but this one first.
I am panning a BR for myself I have recently moved in with my Girlfriend with whom I have no joint debts or Bank accounts I moved in after my house repossession. My question is my JSA benefit changed to a joint claim when I moved in with her as she was a lone parent and claiming income support...now when I moved in this status obviously changed and instead of receiving the £62.xx a week single allowance I now receive £102.xx a week for the 2 of us.....
as she is not part of my BR what do I put down as my Income?? and how do I prepare a budget as my name is not on the rent or any of the associated household bills??? I dont have a bank account and the money is paid to me Through her bank as Jobcentre say's I can have benefit paid to any one's account if I wish.
Obviously I dont draw the money for me she just pays the bills and uses it to put food on the table......
I'm In need of help with this ASAP as I've been looking on here for similar situations for others but have failed to find this out. I have learned a lot from studying this forum and would be glad of any help that anyone can give me.

Council Tax can be a complicated issue, generally if the full amount is due at the time you go bankrupt the debt will be included. If not, then you would still be liable.
As this debt could be classed as one incurred during the term of the bankruptcy, in may be that you are liable. I would recommend that you speak to your official receiver to clarify this.
If you are liable you could try and negotiate with your council and explain that you were not living there and the house was empty etc as most councils will not charge you in this case. You could send the bill from your current house to show you have been paying some council tax and explain that you were unaware that you needed to pay, and if you had known you would of informed them that the house was empty to receive the discount etc

I hope you can help or advise me.
My self and my husband are in a situation and not sure of the best route out.
Firstly I have a debt of £3000 on a credit card
Jointly we have an over draft of £1700.
And my husband has business debts of £20000 approx - which include VAT & Tax and Credit Card
All off these we are unable to pay off. At present I am the only one working as he was let go of a contract last September and has been unable to find work since. I earn just enough to cover our hosuehold bills and food.
We struggle each month to spread what little money we have to pay everyone, and there are of course those that can't be paid (tax, vat & credit card). And then to top it off we get charged by our bank for not being able to pay those bills and for them bouncing at £35 a time....We got charged £275 in charges !!! so therefore this will have a knock on effect for this month and as of today we are over our over draft. Its a continuos cycle....and I want to get off !!!
I really do not know what to do...please help me !!!

Hello,
On the petition forms it asks how much your income is and how much do other people in the household contribute, so you would declare your part of the JSA as your income and then include the other half of the JSA as the contribution to the household - because you have included the contribution you can then list all the household bills in the Outgoing section
You would also have to declare that the JSA was being paid into your girlfriends acc in the Asset section of the form (section 3 - Cash held by anyone for you)
If you are a CCCS client you can ring our Bankruptcy team and we can help you go through this - if your not a CCCS client you can call the Insolvency Service as they have a helpline number and they advise you on how to complete the forms.

When you moved out of the house you should have informed the council of this and they would have given you 6 months grace on the CT as the house is empty. After 6 months most councils will then charge yuo 50% of the CT untill the housed is repo'd and becomes the responsibility of the mortgage co.
Who did you take advice from when yuo decided on BR and have the house repo'd as they should have explained this to you?
