Correcting unfair Ebay negative feedback

Anyone any idea on how to deal with this one?

Prospective buyer asked for pictures of item for sale.
Sent to his address and he bid and won.
Then received abusive email (reported to ebay) saying he wasn’t going to pay. He basically told me to get lost and he wouldn’t leave negative feedback. He accused me of sending the email to him so late he had no option but to bid (the email didn’t go through because his inbox was full!)
Advice from ebay was to unpaid item dispute him and then second chance the next guy (Please note, you mustn’t do this before you’ve closed the dispute otherwise you have two contracts at the same time). Once that was closed he wouldn’t be able to leave negative feedback, particularly in view of abusive email they had seen.
Unpaid item strike left as he didn’t pay and said he wouldn’t pay.
Negative feedback then left, which the trust department removed the words from but will NOT remove the feedback as well.

In summary:
The buyer has not paid for the item.
The buyer has not received the item.
The buyer has not seen the item.
The buyer has been abusive during the ebay process.
The buyer has advised twice that he will not pay for the item.

On this basis alone, how can the buyer be allowed to leave any negative feedback?

Furthermore, the route taken to the acquisition of this negative feedback has been entirely driven by ebay themselves. It was their guidance that got me here.

Anyone any idea of how to force ebay to remove the negative feedback – its of no value as the comments have been removed by ebay anyway.

Appreciate any guidance from anyone who may have experienced the same

    i can't see you getting anywhere with this to be honest (i know thats not what you want to hear) it's very unlikely that you'll convince ebay to remove it and your only other option is to ask the guy to ammend his feedback and make it a positive, but from what you say about the guy it sounds like your chances are slim to none.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    Yes he did, just to have another go and threaten me again. He also said he would not pay and congratulated me on my first negative feedback.
    The point that really gets my goat is that ebay advised me to do this in response to the specific question of how to proceed forward and ensure that I don't get negative feedback.

    Apart from the incredulity of the situation, I have asked ebay to remove it on the basis I only received it through their advices.
    Actually if I had done nothing and left it for long enough, it could have gone away, but I would not be able to sell on the item, would be wondering right up to the 60th day if he would negative feedback me.
    To make matters worse, I cannot tell any other prospective sellers what he is like as ebay have removed that option.
    So one of you out there may and up getting the same treatment.

    The final word from ebay was to get my solicitor to talk to their legal department.
    Am totally p****d off with ebay and feel like just doing boot sales instead!
    Any other words of wisdom greatly appreciated!

    Hmm... here's what I have to add..

    1. Ebay advised you badly - you were never going to be exempt from a neg unless the buyer didn't respond to the dispute.
    2. You have the moral high ground - I trust that you would still have opened a dispute had you not known that you might get negged...? After all, we owe it to the community to give NPB strikes where they're deserved...

    You could probably get the neg removed with a stat dec... but is it really worth it to you? Leave a follow-up to the neg, and move on, that's what I'd be doing.

    even though I had a long shopping list of proof in my favour ebay still refused to remove my unfair neg

    You can leave a carefully worded response to the feedback like "Aggressive buyer wouldnt pay then left unfair neg"

    People wont care about a single neg anyway.

    Wear your negative with pride.

    I received my first negative, after 450 positives, a few months ago because I wouldn't give in to buyer blackmail.

    I had thought that I would hate my 100% record being spoilt but in actual fact it didn't bother me and hasn't affected my sales.

    I left a calm and factual comment which makes it obvious who was at fault.

    It has now disappeared off the first page anyway as it was followed by a string of positives.

    Why get so het up over feedback? It's meaningless, buyers don't care if you have the odd neg here and there.

    I'm the same, 451 positives and one negative - that was from a blackmailing purchaser, too. It makes me really mad that people are allowed to get away with leaving unfair negative feedback. I wish ebay would reinstate the feedback for sellers, it would really help.

    My purchaser's comments were removed by ebay but they didn't remove the neg and said it was my purchasers experience and therefore subjective. They were really supportive regarding the comments, and they didn't remove my reply to her comments which made her look like the unreasonable moo she really was.

    It's annoying that people like us don't get a say in the matter, it's a very unfair system imho.

    How did you do that, may I ask.

    I have had a go at ebay stating I only have it because I followed a procedure they wanted me to and on the basis that the abusive email in the first place would not allow him to leave me any negative feedback.

    I could, after all, have just left it and let it drift into obscurity, but they wanted to be able to show an unpaid items strike against him for what he had done.

    It must be up to then to remove it, its essentially their doing.
