Planning Enforcement Advice

Hi All,
Am I in the right place to pick the brains of Planning experts?
My Parents have received an enforcement notice, and have been told that they may be prosecuted and made homeless. Would a council really make someone homeless? They own the premises and have been paying residential council tax for the past 6 years. The council have suddenly realised that they gave planning permission, but not for residential.
Seems all a bit to odd, but can anyone help?????

Without giving addresses or personal details, can you supply more information please.
I would say that assessing a property for CT and subsequent payment of CT bills would not confer legal usage/occupation upon that property, nor does usage/occupation have to be legal for CT to be assessed/charged.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -

What did they give planning permission for then? That is quite an important point and I doubt if anyone could begin to say anything useful without knowing that.RICHARD WEBSTER
As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.0 -
An Enforcement Notice is never served without warning and they would have had plenty of letters and warnings before it was served. It sounds like they are living in a building which does not have planning permission for a residential use. In which case, they will have to comply with the requirements of the Enforcement Notice (which probably states move out of the building) or it will be a criminal offence. Like RW says above, what was planning permission given for?0

Yes, agree with others; what does the Enforcement Notice actually say?
Bear in mind that although it is not a criminal offence to build or use something without planning permission, it IS a criminal offence not to comply with an enforcement notice.(AKA HRH_MUngo)
