The banks are invoking their legal right to appeal as the OFT could have done on the penalties in law argument. They chose not to. If the Banks' win the case the OFT could potentially appeal to the ECJ. Let's not knock the legal rights of an organisation to appeal a legal case.The ECJ would be the last chance but remember, this bit is nothing to do with actually paying out. Are we expecting there to be a definitive decision on the 24th June or is this going to run and run and run?
What are people's thoughts on this?

No definitive decision on 24th - will probably be 6 - 8 weeks before a decision (and then this doesnt include summer recess) so looking mid/end October.LegalBeagles0

i have a question which has probably been asked many times after the House of Lords has looked at the case and decided that the rules apply then is there anything else left for the banks to do? can the go to any sort of European court is that it? is the House of Lords the last chance for the banks
Should the banks lose in the House of Lords they cannot automatically appeal to the European Court of Justice. Cases to the ECJ can only be referred by the HoLs. The circumstances would have to be exceptional. In 2006 only 2 cases were referred to ECJ.0 -
The appeal hearing in the House of Lords has been moved back a day and will begin on Tuesday 23 June. Although the judges are yet to be appointed there'll be a total of 5 Law Lords hearing the case.0
