Back in 2006/2007 I challenged Abbey's bank charges levied against my then currecnt account. After much hassle Abbey agreed to settle for about £2,500 rather than face me in court. It has only just come to light having looked at my CallCredit credit report that they closed the account in January 2007.
The worrying thing is that they posted a default notice on the file on the same day! No negative entries were posted before or since. This is the most cynical behaviour imaginable, simply because i tried to reclaim the charges. So, I have written to them today to ask that the information be corrected before I escalate the complaint to the Ombudsman.
The banking code states that negative entries cannot be posted against an account that's in dispute. As far as I can see, Abbey waited until the account was settled and closed (therefore no longer in dispute, technically) and then posted a default on the same day. Unbelievable.
So, if you think fighting the banks has no adverse affect, think again. We are forever the little man against these people.
I've spent the last 6 months correcting false information on my credit file(s) and it's amazing how much stuff on there is false. Check your file if you want to apply for credit anytime soon!!
I will post Abbey's reply when they get back to me

So, Abbey's response to my request to correct the information on my CallCredit file was this:
They just posted a default notice on my Experian file, indicating that I had a payment arrangement for 1 month after the account was closed, and that prior to that i had missed 8 payments!
I am utterly stunned. I've spent months and years fixing my file, improving my situation, paying off my debts. The few late payments that were on my file this year have now gone, and now this. I can only believe this is cynical behavior by Abbey towards me. They have posted nothing about me since i had my account 3 years ago. And then the week after i politely request them to correct some false information on one of my files, they post a default notice on my other file...3 years after the account was closed. What is the explanation...I am lost.
I am increasingly thinking they are trying to screw me over since I challenged their charges years ago and won. Every time I've called them they bring up my details and then say "Oh...can you hold on a minute", put me on hold for ages and then come back on the line and stonewall me.
I am putting it in writing, of course, starting the whole f*cking process of asking them to correct their mistake. It's so simple for them to just post misinformation about us, and then up to us to have it corrected. I am so unbelievably tired of this I just want to cry. I have no power. Now i wait 28 days before writing to the Ombudsman and Information Commissioner...all I want to do is drag them through the courts and waste their time like their wasting mine.
Now I have a false default on my file...so im back to square one. All that effort and patience, the evidence of which has disappeared overnight.0 -

How much was the default for?
Am I right in saying that you were repaid £2500?0 -

I was paid about £2,500 in 2006. The default is for £108. This was posted on my credit file on the same day the account was closed.
I have a theory (maybe flimsy). I've raised a complaint with the Financial Ombudsman concerning Alliance & Leicester posting incorrect information on my credit file. Abbey bought A&L a while ago. I havent heard from Abbey since I closed the account in 2006. A week after i send a complaint about A&L, Abbey decide to post a default notice on my credit file from an account closed 3 years ago.
Also, a similar default was posted on my CallCredit file relating to the same bank account, but all the details are different...different dates, details of an arrangement etc.
I should state quite clearly, the account was never in an arrangement and nor was it ever in arrears or defaulted. I've written to Abbey (again) asking for copies of all the alleged default notices/letters.
If I can find a way using Data Protection law, I will take them to court...I'm so fed up of this. At a keystroke they can post false information abot us, which then takes months to correct.0 -
