HELP what can i do?

Looking for a bit of advice here. I bought 3 fruit trees from Ideal world at the end of feb but one of them appears to be dead as the other 2 have (Apple & Plum) leaves all over them and this one (Pear) has nothing not even shoots even though they have all been planted in exactly the same way. I have emailed them and they finally got back to me after a week of waiting with the statement :mad:
'With reference to your query as you have already planted the trees we are sorry to inform you but we are unable to do anything for them now. Please accept our sincere apologies for any inconvenience caused with regards to this matter'
Can they do this as the good are obviously faulty but I had no way of knowing this untill they started producing leaves?
Any advice would be apreciated.
