Returning damaged ebay item

Hi, I've done a quick search around and can't find quite what I'm after.

I won a dress on ebay and it's arrived damaged. The seller has agreed via messaging to give me a refund once I've sent it back (whether or not the refund will include postage is another matter entirely!).

I just wondered whether I need to open a dispute to cover myself before I send it back, or will I just be alright sending it recorded?

I'm worried that I'll send it back and the seller won't refund, then I'll be dress-less and money-less and unsure whether paypal would still cover it.

    Save the dispute in case they fail to refund.
    Trackable would be best just in case you need to prove delivery.
    My TV is broken! :cry:
    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    fay means don't open a dispute yet, 'save' it in case you have problems.

    Thanks for your replies guys. I posted it back recorded to her without opening a dispute and surprise surprise I got a message this morning saying that the zip does up fine both on and off her and she can't find any boning poking out of the fabric :rolleyes:

    Luckily I had the foresight to take photos of the faults before I posted it back to her, so have politely messaged her telling her this and that I shall be using them as evidence for a dispute if I do not hear back from her with a full refund.

    Am I doing right?

    Yep that is good.

    Two things to check though, firstly keep hold of the tracking info that shows item was delivered safely to seller, and secondly watch your time limits as you only have 45 days to open a chargeback.

    Thanks soolin. I'll give it until tomorrow eve (she's been quick with replys until now...) for a refund then I'll open the dispute. Have got the tracking details safe and sound!
