Sat nav packs up 2 month out of warranty

My brother-in-laws Binatone Sat Nav has packed up. He bought it at Argos in February last year.
He has only used it 5 times.
His wife has rung Argos and Binatone and both say there is nothing they can do because it is out of guarantee.
What do they do now?

Sale of Goods Act applies, don't forget that a warranty is in addition to your statutory rights and cannot take them away, a retailer,(not the manufacturer), can be responsible up to 6 years for repairs, see this page from Consumer Direct,(also other links on there; -
"If the retailer or manufacturer’s warranty has run out, the shop is often quick to say there is nothing they can do before attempting to sell you an extended warranty. This is misleading. If you buy something which should last 7 years but breaks down after a year and a day, you can still claim it was of poor quality in reference to the durability aspect."

From WHICH; - "You have six years to make a claim for faulty goods in England, Wales and Northern Ireland; in Scotland you have five years."

What do you mean by "packed up". If it means will not come on at all then it is probably because the battery has died due to lack of use which could be considered misuse / abuse. It happens a lot on these items when not used.0

If it has been used, as the OP says it has, and the battery has "died" then that will mean that the battery is "not fit for purpose" under SoGA, ('of satisfactory quality', and 'fit for purpose), unless the manual stated that the battery has to be always charged, which I would think unlikely, (mine does not, and is not used much but still works), then I cannot see how that would constitute misuse / abuse.

I always associate that manufacturer with kiddie level toys and cheap tat..
Try taking the battery out for a while, ejecting any memory cards in it, and restarting without any cards and fresh batteries. My Streetpilot i2 did something similar after a storage period. I also have a dead line on the LCD, but it was cheap and still works.0 -

Yep Binatone make loads of stuff, (not sure about the reliability), AFAIK the batteries cannot be taken out as they are a sealed unit.Don`t steal - the Government doesn`t like the competition0 -
Derrick is right about the SOGA. You have no right of recovery from Binatone because their warranty is the only recourse you have against them, and that has expired. But you have statutory rights against Argos, who sold the product. Warranties from the seller themselves are not worth the paper they're written on, because the SOGA often trumps that 'guarantee' entirely, and it will do so here. Don't allow Argos to tell you that they cannot do anything because the warranty has expired. That is a commonly used but entirely incorrect line."MIND IF I USE YOUR PHONE?
