Hello all, this is the debut post so bare with me 
Big up RTM for pointing me towards here, (Does anyone know what RTM stand for by the way???)
I purchased this on November 22nd, and paid via cheque £97 which cleared on 07/12/04.
I have had no contact from the seller since, and he does not answer the mobile phone number he left on his account.
Now, if you see his feedback he is no longer a registered user, and has stitched up many other users!! >:( >:( >:(
I am now nearly £100 out of pocket, and pretty damn !!!!!! off with the whole situation....any advice from the ebay gods of this forum???

all i can suggest is emailing ebay and trading standards.....

2nd piece - now go after them. All that is needed in order for evil to succeed is that good men do nothing.
The time for doing nothing has come to an end - doing nothing is not an option....
A few ideas....
Subscribe the cell phone number you have to as many premium rate services as possible (over the internet....and cover your tracks) at £2.50 per text you need to do at least 50... :-X
Put a few freeads up with bargains connected to that number (fill the mailbox). ::)
Write to the bank if you paid by cheque - complain - report it to the police (a must) to add to any statistical fraud that the perpetrator may have committed; scream blue murder revealing all his details on every forum you can...

and chase it - if you're going to loose the money - at least have some revenge.
Chase up every lead you can. Write to the phone company and ask for details of the owner - they probably won't give them but try; ask the police to do the same.
Hunt chase chase push.....

I would hold your horses on this one for now.
If you check out the sellers feedback, the seller has been suspended for the non performing seller side of things. Maybe as other feedback saying that he / she was on holiday was left, then i would wait for a reply. I would give it too the 20th or something. Maybe the seller is awaiting stock, but now is suspended the contract has become void. As you paid by cheque, you will most likely be unable to claim any cash back. eBay would give you some cash back towards the payment, but I would register on the eBay community forum and take it from their.
I would email a few of the sellers previous customers, give them your sob story and ask them to help you find his address. You should have his address if you sent him a cheque...but if this is not the case then i would look to getting more information about the seller.
Take what information you have, and use it within google, its amazing what you can find on the internet by putting your name into the search engine. The phone is probably a Pay-as-you-go mobile so subscribing to the premium line numbers will not really do much, hassling the guy will force him to turn it off, or ignore any numbers he / she does not recognise.
Try get a postal address, name..then put into Bt.com residential site for a landline number. Then start ringing his house number. Im sure you can associate other family members from the phonebook. Remember to do a 141 before dialing so they cant trace you. But dont forget they have your details too.
Maybe the seller is keeping the cash for christmas, but you may consider that their has been a problem, and the cash me be returned, whilst in the meantime, you has deformed his / her character on this site.
Contact previous customers for details on them
Post your problem on the eBay community forum
Contact the bank for advice
Contact the Citizens Advice Bureau (for advice)
Contact the police to report as theft
Dont get stressed out, put it down to badloss, dont use cheque again unless happy the seller is going to complete the deal.

To look on the optimistic side, he has had a lot more items for sales recently than he has had negative feed back for:

So it could be that he is just very poor at organising delivery, or it could be that he has been taken ill (which I have seen before result in a sudden NARU when buyers get worried).
As you have his address from sending the cheque, have you tried 192.com for alternative phone numbers.

I would say that he also appears to have a second account which has also been suspended - check the first page of feedback with about 5 positives from the same seller. Obviously an attempt to bump up his own feedback!
This seller has DODGY written all over them. Don't sit around, bombard his mobile till you get a reply. He will answer it sooner or later.0 -
Get his/her address(if you dont have it email every person that has either bought or sold anything to them, explaining your situation, asking for their address, if they dont beleive you you can tell them to check his feedback) then once you receive the address, send a "letter before action" stating the dates of when you made the purchase, how much you paid etc, and how there have been no goods delivered. Include in the letter this is the last time they have to settle this issue... state they have 3-4 working days to contact you personally to sort this out, otherwise you will file a claim though the small claims court. Send the letter 'recorded delivery' so they have to receive it and sign for it.
If that doesn't scare them into sorting somthing out, then go through the proceess of a small claims court where you can apply online through their website: https://www.moneyclaim.gov.uk/csmco2/index.jsp
Oh and don't sign his mobile upto !!!!!! lines etc, or give out his details on forums because by doing that you are simply giving them things to throw back at you once the claim is made....as quite frankly its immature and you stoop to their level of intelligence.!"£$%^&*()0 -
