means tested.

long time lurker but first time poster so please be kind!!.
My dh is in reciept of DLA middle rate and IB .He is off work with severe Depression .
He is about to be awarded £20.000 as a result of an accident. The other side also are paying back just over £13k in benefits that he has received during the time he has been off sick.
My question is are DLA and IB means tested?
Thank you for any advise offered.

    yes £6000 in savings althought it could be seen you were delibrately trying to spend money to be under the threshold if your not careful so you may want to explain the whole lot in writing to job centre including about your roof

    IB is NOT means-tested if it is contributions -based (i.e. if it is Incapacity Benefit and not Income Support on Grounds of Incapacity ).

    If it's IB the only thing that affects it is an Occupational Pension. If you have a Pension of over £85 a week, 50p in the £1 is deducted from IB for every £1 over the £85.

    If it is Income Support then what the above poster says is correct. £6k is the lower limit and deductions will start there. If you have over £16k in savings you won't get anything.

    The initials IB can be a little confusing. There is JSA (IB) which IS means tested. However if your DH is on Incapacity Benefit that is NOT means tested.
    Therefore you would be able to appreciate the capital without effecting the benefits.

    Thanks for the response. He is in receipt of Incapacity Benefit and the Middle rate of DLA.We are currently appealing the middle rate award with the help of the mental health Advocacy service.

    sdw is correct, IB is not means tested. However if you receive IS on top of the IB, IS is means tested.
    Gone ... or have I?

    if the capital is compensation for a personal injury it might well be disregarded in the means test anyway.
    I work in Housing Benefits however my comments are my own understanding of the law / procedures and you should also check with your local authority.

    For a period of time - usually 52 weeks - after that it can be taken into account.
